Article 62. Powers of local executive bodies in the execution of punishment in the form of involvement in public works the Criminal executive code of the Republic of Kazakhstan
1. local executive bodies of the district in the city, city of district significance, village, Village, Rural District:
1) within five working days from the date of receipt of the verdict or decision of the court:
determine the types of unpaid work that do not require certain qualifications, useful to society, as well as objects for their performance in public places, taking into account the safety of working conditions;
to issue an order on the organization of the performance of Public Works, indicating the data of the convicted person, the type of work useful to society that is not paid for, the object for their performance, the conditions for execution, the responsible organization, the duration of the time of work for convicts not exceeding four hours a day, and for convicts who do not have a permanent place of work and do not study in educational institutions – up to eight hours a day, but not more than forty hours a week, the time of rest;
to send to the Probation Service a notification of receipt of a court verdict or decision and an order on the organization of Public Works;
2) take measures to provide a convicted person with a vest and equipment, tools and other means necessary for the performance of Public Works, determined by the authorized body in the field of Penitentiary Service, a sample of a uniform;
3) no later than the last working day of the current month, send to the Probation Service a record of the time worked and an act of work performed, as well as information about the behavior of the convicted person;
4) inform the Probation Service of the fact of evasion of the convicted person from performing public works.
2.failure of officials of local executive bodies to perform the duties specified in the first part of this article in the execution of punishment in the form of involvement in public works entails liability established by law.
