Article 43. Involvement in community service  The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1. Community service consists in the performance by a convicted person of free socially useful work that does not require certain qualifications, organized by local executive bodies in public places.

     2. Community service is established for criminal offenses for a period of twenty to two hundred hours, for crimes of minor and moderate severity – for a period of two hundred to one thousand two hundred hours. Community service is served for no more than four hours a day, with the release of the convicted person for the duration of their service from performing work duties at their place of main work or in their free time.

     2-1. In case of evasion from public works, they are replaced.:

     1) convicted of a criminal offense – by arrest at the rate of one day of arrest for four hours of community service not completed;

     2) convicted of a crime – by restriction of liberty or imprisonment at the rate of one day of restriction of liberty or imprisonment for four hours of community service not completed.

     2-2. If a more lenient punishment is imposed than is provided for this criminal offense, if a punishment is imposed for an unfinished crime, as well as if the punishment is commuted, the term of community service may be lower than the lower limit established by this article.

     3. Community service is not assigned to pregnant women, women who have or are raising a minor child under the age of three, men who are raising a minor child under the age of three alone, women aged fifty-eight and over, men aged sixty-three and over, persons with disabilities of the first or second group, military personnel.
