Article 560. Request for legal assistance CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. A request (instruction, petition) for the provision of legal and other assistance shall be drawn up by the competent authority in accordance with the requirements of this Code and (or) the relevant international treaty of the Republic of Kazakhstan.
2. The request (instruction, petition) and the documents attached to it shall be drawn up in writing on the appropriate form, certified by the signature of the authorized official and the stamp of the relevant authority.
3. The request (instruction, petition) and the documents attached thereto shall be accompanied by a translation into the language defined by the relevant international treaty of the Republic of Kazakhstan, and in its absence – into the official language of the requested party or another language acceptable to that party.
4. The request (instruction, petition) is sent by the central body of the Republic of Kazakhstan to a foreign state by mail, and in urgent cases – by electronic, facsimile or other means of communication. In this case, the original request will be sent by mail no later than three days after its transmission by e-mail, fax or other means of communication.
5. In case of refusal to send a request (order, petition), all materials are returned by the central authority of the Republic of Kazakhstan to the relevant body conducting the process, outlining the shortcomings that need to be eliminated or explaining the reasons for the impossibility of sending the order.
6. The central authority of the Republic of Kazakhstan may accept for consideration a request (instruction, petition) received from the requesting party by electronic, facsimile or other means of communication. The execution of such a request (order, petition) is carried out solely on condition of confirmation of the sending or transmission of its original. Sending the materials of the executed request (order, petition) to the competent authority of a foreign state is possible only upon receipt by the central authority of the Republic of Kazakhstan of the original request.
