Article 620. The procedure for approving the procedural agreement on cooperation of the CPC of the Republic of Kazakhstan The Criminal Procedure Code of the Republic of Kazakhstan
The Prosecutor General of the Republic of Kazakhstan, the Chief military Prosecutor, the Chief Transport Prosecutor, the prosecutor of the region or the prosecutor equivalent to him, their deputies in relation to the suspect, the accused, the defendant, the convicted according to the procedural agreement received for approval:
1) study the criminal case and the additional materials submitted (requested), verify the legal and factual grounds for concluding a procedural cooperation agreement, and also assess the nature of the intentions of the suspect, accused, defendant, convicted person to perform actions that are the subject of the agreement;
2) find out whether the suspect, accused, defendant, convicted person is familiar with all the conditions and requirements related to the procedural cooperation agreement, whether they have been subjected to torture and other cruel, inhuman or degrading treatment or punishment, whether they voluntarily concluded a procedural cooperation agreement and whether they are aware of its legal consequences;
3) approve the procedural cooperation agreement or issue a resolution to refuse to approve it.
