Comment to Article 39. Location of a legal entity of the Civil Code of the Republic of Kazakhstan

The practical importance of accurately determining the location of a legal entity is to identify a place where it is possible to determine where to send business and official correspondence addressed to the legal entity. Therefore, the location of the legal entity is indicated in registration documents, on letterheads, in the text of contracts concluded by this legal entity, etc.

The location of a legal entity determines important conditions for its creation and operation - the choice of a registering authority, the choice of a judicial authority when suing a legal entity or against a legal entity, the determination of the place of performance of obligations (art. 281 CC) and in many other cases. Sometimes the law even applies.
