The direct object of the offense provided for in Article 523 of the Administrative Code is the procedure established by the legislation of the Republic of Kazakhstan and protected by the State for carrying out the activities of customs carriers in the Republic of Kazakhstan.
The subjects of the offense provided for in Article 523 of the Administrative Code are the customs carriers directly indicated in the commented norm.
According to paragraph 1 of Article 495 of the Code of the Republic of Kazakhstan "On Customs Regulation in the Republic of Kazakhstan", a customs carrier is a legal entity of the Republic of Kazakhstan that meets the conditions specified in the cited Code. A legal entity is recognized as a customs carrier after being included in the register of customs carriers. The register of customs carriers is maintained by the authorized body. A customs carrier transports (transports) goods under customs control through the customs territory of the EAEU. The status of the customs carrier is confirmed by a document, the form of which is determined by the Commission. The specified document is issued by the territorial customs authority after the legal entity is included in the register of customs carriers.
The subjective side of offenses, the subjects of which are legal entities, is not subject to determination due to the existence of a legal requirement to establish guilt as a condition for bringing to administrative responsibility, only in relation to individuals. According to the legislation of the Republic of Kazakhstan on administrative responsibility, legal entities are administratively liable for the mere fact that they have committed an illegal act or omission, for which administrative liability is provided for in the Administrative Code, without taking into account the guilt of the officials of the legal entity who committed this act.

At the same time, vehicles intended for the special activities of customs carriers and special technical equipment on them, which makes it possible to determine the location of the vehicle, must comply with the special requirements imposed on them in the Code. After the inclusion of customs carriers in the relevant register, they must timely and fully fulfill the duties assigned to them by the Code of the Republic of Kazakhstan "On Customs Regulation".
Accordingly, violation of the specified requirements and conditions for carrying out the activities of a customs carrier or the requirements imposed by the customs legislation of the EAEU and (or) the Republic of Kazakhstan on its vehicles and special equipment on them forms the final composition of the administrative offense provided for in the commented article.
The offense provided for in the commented article is considered to have been committed at the moment when the customs carrier has ceased to comply with the conditions of its activity established in the Code or has not fulfilled the duties assigned to it by the Code, or when its vehicles and equipment on them do not meet (have ceased to meet) the requirements established by the customs legislation of the EAEU and (or) the Republic of Kazakhstan.
An administrative penalty in the form of a fine has been imposed for committing an offense under Article 523 of the Administrative Code.
