Article 1. The basic concepts used in this Law of the Law On Responsible Treatment of Animals  

     The following basic concepts are used in this Law:

     1) trapping service is a state veterinary organization established by local executive bodies of regions, cities of republican significance, the capital, as well as individual entrepreneurs and non–governmental legal entities engaged in trapping, temporary maintenance and killing of animals;

     2) wild animals – animals whose natural habitat is wildlife, including those kept in captivity and (or) semi-free conditions;

     3) cruelty to an animal is an intentional act that has led or may lead to death, injury or other harm to the animal's health.;

      4) euthanasia of an animal (hereinafter referred to as euthanasia) is the medical killing of an animal that excludes causing pain and physical suffering to the animal.;  

     5) the owner of an animal is a natural or legal person to whom the animal belongs by right of ownership or other proprietary right;

      6) animals – vertebrates;  

     7) an animal rehabilitation center is a property complex designed and equipped for the limited reception, treatment, temporary detention, rehabilitation and adaptation of animals that are or are not subject to return to the owner of the animal and (or) the responsible person or to their natural habitat, who find themselves in a situation threatening their life and health, unable to exist in natural conditions. conditions, as well as pets (companion animals) seized or confiscated from individuals or legal entities;

     8) animal shelter – a property complex designed and equipped to house animals in a situation threatening their life and health, neglected and stray animals, as well as pets (companion animals) seized or confiscated from individuals or legal entities;

     9) a public inspector in the field of responsible treatment of animals (hereinafter referred to as a public inspector) is an individual who exercises public control in the field of responsible treatment of animals in accordance with the rules for conducting public control in the field of responsible treatment of animals.;

     10) the authorized body in the field of responsible treatment of animals is the central executive body responsible for the management and intersectoral coordination in the field of responsible treatment of animals.;

     11) temporary animal detention facility – a property complex specially designed and equipped for the temporary detention of found, captured stray and stray animals, as well as pets (companion animals) seized or confiscated from individuals or legal entities;

     12) animal fight – a fight between two or more animals that has arisen as a result of pitting them against each other or as a result of their breed characteristics, with the deliberate failure of the owner of the animal and (or) the responsible person to take measures to prevent or stop it.;

     13) responsible person – a person who bears the rights and obligations of the owner of an animal, established by this Law, on the written instructions of the owner of the animal;

     14) mobile menagerie – specially equipped mobile structures, including cages, used for public demonstration of animals in circus, variety, entertainment activities that have no scientific significance, by keeping and transporting animals;

     15) zoological hotel is a property complex created by an individual entrepreneur or a non–governmental legal entity, designed and equipped for temporary maintenance or overexposure of pets (companion animals) in agreement with the owners of the animals;

     16) a zoological nursery is a property complex created by an individual entrepreneur, a state or non–state legal entity, specially equipped and designed for the maintenance and breeding of animals with breeding value or special purpose;

     17) petting zoo – specially equipped facilities, premises, vehicles, cages, fences and other structures used for keeping animals for the purpose of their public demonstration and providing physical contact with visitors;

     18) stray animals – dogs and cats that do not have an owner;

     19) neglected animals – animals that are outside the place of detention and for which control has been lost by the owner of the animal and (or) the responsible person;

     20) service animals – animals specially trained and used (used) for search, patrol, patrol, guard, search and rescue and other official purposes established by the legislation of the Republic of Kazakhstan;

     21) mutilation is a serious harm to the health of an animal that has resulted in complete or partial loss of function of any organ, as well as a violation of the anatomical integrity of the animal, except in cases defined by the legislation of the Republic of Kazakhstan in the field of veterinary medicine.;

     22) sterilization – depriving an animal of the ability to reproduce offspring by surgical, medicinal or other means;

      23) place of detention – buildings, structures, facilities, premises or land plots used by the owner of the animal and (or) the responsible person where the animal is kept;  

      24) pets (companion animals) (hereinafter referred to as pets) are animals, regardless of their species, that are traditionally kept and bred by humans to meet aesthetic and social needs;  

     25) accounting of pets is the mandatory registration of information about the assignment of an individual number to a pet, its owner with a place of residence and veterinary activities carried out;

     26) products (means) of accounting for pets – boluses, chips and other products (means) used for accounting for pets;

     27) pet walking – actions of the owner of the animal and (or) the responsible person, involving the removal of the animal outside the place of its detention and aimed at meeting the physiological needs of the animal in physical activity, the provision of natural needs;

     28) self–care of pets - independent stay of pets outside the place of detention without the presence of the owner of the animal and (or) a responsible person;

     29) experimental (laboratory) animals are animals that are bred, kept and used for scientific research, biological testing, educational process, for medical purposes, as well as for obtaining biomedical drugs.

 

     This Law regulates public relations in the field of responsible treatment of animals in order to protect them, ensure safety, strengthen morality and respect the principles of humanity of society in the treatment of animals, as well as protect the rights and legitimate interests of individuals and legal entities in the treatment of animals.
