1. Users of the animal world, with special use, have the right:

1) to carry out only those types of use of the animal world that they are allowed;

2) to use objects of the animal world in accordance with the terms of their provision;

3) ownership of the extracted objects of the animal world, including hunting and fishing trophies, and the products obtained thereby, as well as for their transportation and sale;

4) excluded by the Law of the Republic of Kazakhstan dated 25.01.2012 No. 548-IV (effective after ten calendar days after its first official publication);

5) conclude contracts with individuals and legal entities for the use of wildlife;

6) construction of temporary facilities for the needs of hunting and fishing farms in accordance with the established easement;

6-1) provide rangers with service weapons in accordance with the norms and rules established by the legislation of the Republic of Kazakhstan;

7) carry out wild breeding and conduct amateur (sports) hunting in the territory designated for wild breeding (in captivity and (or) semi-free conditions), as well as independently use animals reproduced as a result of wild breeding;

8) transfer of the fisheries reservoirs and (or) their areas for fishing assigned to them to fisheries reservoirs and (or) their areas for fish farming (aquaculture);

9) to organize cage fish farming in the fisheries reservoirs and (or) areas assigned to it for conducting fishing with a positive conclusion of the state environmental assessment, if there is a biological justification with a positive conclusion of the state environmental assessment. Subparagraph 9) is provided to be deleted by the Law of the Republic of Kazakhstan dated 06/12/2025 No. 194-VIII (effective sixty calendar days after the date of its first official publication).

2. Users of the animal world, in case of special use, are obliged to:

1) comply with the requirements of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife;

2) timely pay a fee for the use of wildlife in accordance with the procedure established by the tax legislation of the Republic of Kazakhstan;

3) excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication). 4) excluded by the Law of the Republic of Kazakhstan dated 06/15/2017 No. 73-VI (effective ten calendar days after the date of its first official publication);

5) to prevent the deterioration of the animal habitat by complying with the environmental requirements stipulated by the Environmental Code of the Republic of Kazakhstan, except in cases of pollution from the insurmountable consequences of natural disasters;

6) to use wildlife in ways that are safe for the public and the environment, preventing violations of the integrity of natural communities and cruelty to animals;

7) to carry out annual accounting of the number of used wildlife objects for hunting subjects and to submit reports in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

7-1) submit administrative data to the authorized body in accordance with the forms approved in coordination with the authorized body in the field of state statistics intended for the collection of administrative data;

7-2) submit administrative data to the authorized body in the field of fisheries in accordance with the forms approved in coordination with the authorized body in the field of state statistics for the collection of administrative data;

8) to ensure the protection and reproduction of objects of the animal world, including rare and endangered, and to prevent a decrease in their numbers beyond its natural fluctuations;

9) carry out the necessary measures to ensure the reproduction of wildlife in accordance with the development plans of hunting and fishing enterprises;

10) not to interfere with the implementation of inspections for the purpose of state control and supervision of compliance with the requirements of the legislation of the Republic of Kazakhstan on the protection, reproduction and use of wildlife, conducted in accordance with Article 49 of this Law;

11) provide an easement for the implementation of:

control fishing – to the territorial subdivision of the department of the authorized body in the field of fisheries;

scientific research fishing - for individuals and legal entities;

amateur (sport) fishing - to individuals;

amateur (sports) hunting – for individuals;

12) to carry out current fisheries reclamation on a fixed fishery reservoir and (or) site on the basis of scientific recommendations;

13) install full houses;

14) keep a logbook of fishing resources and other aquatic animals at each fish receiving point, brigade or unit (fishing log) and present it at the request of officials of the department of the authorized body in the field of fisheries and its territorial divisions.;

15) in accordance with the procedure and within the time limits established by the authorized body, send to the territorial division of the department information on concluded contracts with individuals and legal entities for the use of wildlife, including their termination;

16) in accordance with the procedure and time limits established by the authorized body in the field of fisheries, provide it with information on the catch of fish resources and other aquatic animals, the fishing situation in the reservoir, issued permits in accordance with the forms approved by the authorized body in the field of fisheries;

17) when carrying out emissions into the environment, obtain an environmental permit in accordance with the Environmental Code of the Republic of Kazakhstan;

18) provide huntsmen with means of transport, communications, special clothing with insignia, a huntsman's badge, and a huntsman's certificate;

19) comply with fire safety requirements;

20) issue permits for amateur (sports) hunting and amateur (sports) fishing to individuals in paper or electronic form upon their oral, written or electronic application;

21) approve the internal regulations of the hunting industry;

22) notify the department of the authorized body about the creation of a zoological collection;

23) comply with fishing effort standards;

24) to stock a fixed fishery reservoir and (or) a site in accordance with the development plans of the subjects of fisheries on the basis of the recommendations of a scientific organization;

25) excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).

Notifications are submitted by applicants to the department of the authorized body or the authorized body in the field of fisheries at least ten working days before the start of activities or actions in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Permits and Notifications".

3. Users of the animal world have the right to use objects of the animal world in order to satisfy their cultural and aesthetic needs.

4. Users of the animal world in general use are obliged to:

1) comply with the requirements of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife;

2) to prevent the deterioration of the animal habitat by complying with the environmental requirements stipulated by the Environmental Code of the Republic of Kazakhstan, except in cases of pollution from the insurmountable consequences of natural disasters;

2-1) comply with fire safety requirements;

3) comply with other requirements for the protection, reproduction and use of wildlife provided for by legislative acts of the Republic of Kazakhstan.

5. Illegal interference in the activities of wildlife users by government agencies, officials and organizations is prohibited.

This Law regulates public relations in the field of protection, reproduction and use of wildlife, as well as the conservation and reproduction of Kazakh dog breeds and is aimed at ensuring conditions for the conservation of wildlife and its biological diversity, sustainable use of wildlife in order to meet environmental, economic, aesthetic and other human needs, taking into account the interests of present and future generations..
