Article 186. Types and organization of industrial monitoring of the Environmental Code of the Republic of Kazakhstan

1. Production monitoring is an element of industrial environmental control, as well as a program to improve environmental efficiency.

     2. As part of the production monitoring, operational monitoring, environmental emissions monitoring, and impact monitoring are performed.

     3. Operational monitoring (monitoring of the production process) It includes monitoring the parameters of the technological process to confirm that the performance indicators of the facility are in the range that is considered appropriate for its proper design operation and compliance with the conditions of the technological regulations of this production. The content of operational monitoring is determined by the facility operator.

     4. Monitoring of emissions into the environment is the monitoring of the quantity, quality of emissions and their changes.

     Environmental emissions monitoring at category I facilities should include the use of an automated environmental emissions monitoring system.

     Automated system National Data Bank on the state of the Environment and Natural Resources of the Republic of Kazakhstan – an automated industrial environmental monitoring system that monitors environmental emissions from the main stationary sources of emissions, which provides data transmission to the digital system National Data Bank on the State of the Environment and Natural Resources of the Republic of Kazakhstan in real time in accordance with the rules of the automated system National Data Bank on the State of the Environment and Natural Resources of the Republic of Kazakhstan when conducting industrial environmental control, approved by the authorized body in the field of environmental protection.

     The functioning of the automated monitoring system, the measurements carried out by it, their processing, transmission, storage and use must comply with the requirements of the legislation of the Republic of Kazakhstan in the field of technical regulation, on ensuring the uniformity of measurements and the digital legislation of the Republic of Kazakhstan.

     5. Impact monitoring is included in the industrial environmental control program in cases where it is necessary to monitor compliance with the requirements of the environmental legislation of the Republic of Kazakhstan and environmental quality standards or is defined in a comprehensive environmental permit.

     6. Exposure monitoring is mandatory in the following cases::

     1) when activities affect sensitive ecosystems and public health;

     2) at the stage of commissioning of technological facilities;

     3) after emergency emissions into the environment.

     7. Impact monitoring may be carried out by the facility operator individually, as well as jointly with operators of other facilities in coordination with the authorized body in the field of environmental protection.

     8. Industrial monitoring of emissions into the environment and impact monitoring are carried out by laboratories accredited in accordance with the procedure established by the legislation of the Republic of Kazakhstan on accreditation in the field of conformity assessment.

     The person carrying out production monitoring is responsible in accordance with the Code of the Republic of Kazakhstan on Administrative Offences for providing false information on the results of production monitoring.

     9. Production monitoring data is used to assess the state of the environment within the framework of the Unified State Monitoring System for the Environment and Natural Resources.
