Article 356. Procedures for closure, reclamation and monitoring of a landfill (part of a landfill) Environmental Code of the Republic of Kazakhstan
1. The closure of a landfill (part of a landfill) for waste disposal is allowed only after obtaining an environmental permit.
2. A landfill (part of a landfill) for waste disposal may be considered closed only after officials of the authorized body in the field of environmental protection and the state body in the field of sanitary and epidemiological service have conducted a final inspection of the site, evaluated all the information provided by the operator of the landfill, and informed him of the approval of the closure of the landfill (part polygon). At the same time, the landfill operator is not exempt from fulfilling the conditions of the environmental permit.
3. After the closure of the landfill (part of the landfill), the landfill operator recultivates the territory and monitors landfill gas and filtrate emissions for thirty years for Class 1 landfills, twenty years for Class 2 landfills, and five years for Class 3 landfills. Funds for reclamation of disturbed lands and subsequent monitoring come from the landfill's liquidation fund.
4. Landfill reclamation includes measures to stabilize waste in the body of the landfill, anti-erosion protection and landscaping of the landfill slopes, taking into account the natural and climatic conditions of the landfill area. Requirements for landfill remediation are established by state standards in the field of architecture, urban planning and construction.
5. After the landfill operator has carried out the reclamation of the landfill (part of the landfill) in accordance with the terms of the project and the completed work has been accepted by an act of the acceptance commission with the participation of the authorized body in the field of environmental protection, the landfill operator stops monitoring the environment.
