Article 51. Conducting fishing, research, prospecting or other activities in the internal and territorial waters, including those aimed at preserving the mineral or living resources of the continental shelf of the Law on the State Border of the Republic of Kazakhstan
1. Conducting fishing, research, prospecting or other activities in the internal and territorial waters, including those aimed at preserving the mineral or living resources of the continental shelf, should not harm the economic, environmental, defense or other security of the Republic of Kazakhstan or contain a threat of such damage, as well as create obstacles to the performance of tasks by the Border Guard Service of the National Security Committee. the Security Service of the Republic of Kazakhstan and other authorized bodies.
2. When submitting submissions to the Border Guard Service of the National Security Committee of the Republic of Kazakhstan for access to territorial waters, state bodies of the Republic of Kazakhstan and organizations that intend to conduct marine scientific research and (or) exploration activities in territorial waters, in addition to the information specified in paragraph 2 of Article 48 of this Law, are required to provide full information on:
1) the nature and objectives of the project;
2) the method and means to be used, including the name, type and class of vessels, description of scientific equipment;
3) accurate geographical data on the areas in which the project will be conducted;
4) the date of arrival and departure of the research vessels or, where appropriate, the placement and removal of equipment;
5) the name of the organization, the head or the person responsible for the project.
3. The Hydrographic Support Service of the Naval Forces of the Armed Forces of the Republic of Kazakhstan is notified of upcoming marine scientific research and (or) exploration activities in territorial waters at least ten calendar days before the start date of work.
4. Access to internal and territorial waters, including ice fishing by amateur fishermen, tourists, and athletes, is carried out on a general basis in accordance with the procedure established by this Law.
5. Control over the conduct of fishing, research, exploration or other activities in internal and territorial waters, including those aimed at preserving the mineral or living resources of the continental shelf, is entrusted to the authorized state body in the field of protection, reproduction and use of wildlife, which carries out these activities jointly with the National Security Committee of the Republic of Kazakhstan, the Ministry of the Ministry of Internal Affairs of the Republic of Kazakhstan and the Ministry of Defense of the Republic of Kazakhstan.
