Article 57. State registration and implementation of the Housing and Construction Cooperative Act on Housing Relations

Article 57. State registration and implementation of the Housing and Construction Cooperative Act on Housing Relations  

     1. The state registration of a housing and construction cooperative is carried out by the judicial authorities in accordance with the procedure established by the legislation of the Republic of Kazakhstan on state registration of legal entities and registration of branches and representative offices.

     The housing and construction cooperative carries out the construction of an apartment building in accordance with the requirements of the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities.

     2. The location of the housing and construction cooperative is the location of the permanent executive body of the housing and construction cooperative.

     3. In case of a change of location, the executive body of the housing and construction cooperative is obliged to notify the judicial authorities.  

     4. The housing and construction cooperative has the following powers:

     1) engage in activities aimed solely at the construction of an apartment building;

     2) appeal against acts of state bodies or actions (inaction) of their officials, acts of local self-government bodies that violate the rights of housing and construction cooperatives, in accordance with the procedure established by the legislation of the Republic of Kazakhstan on administrative procedures and the legislation of the Republic of Kazakhstan on administrative proceedings;

     3) exercise other rights of a legal entity necessary to achieve the goals stipulated by the charter of the housing and construction cooperative.
