On certain issues related to establishing exemptions from the national treatment regime

Resolution of the Government of the Republic of Kazakhstan dated April 23, 2026, No. 314

In accordance with paragraph 2 of Article 9 of the Law of the Republic of Kazakhstan “On Public Procurement,” the Government of the Republic of Kazakhstan RESOLVES:

     1. When carrying out public procurement, establish exemptions from the national treatment regime for:

     1) goods from the machine‑building industry originating from foreign countries, with the exception of goods not produced on the territory of the Republic of Kazakhstan;

2) goods of the chemical industry originating from foreign countries, with the exception of goods not produced on the territory of the Republic of Kazakhstan;3) goods of the metallurgical industry originating from foreign countries, with the exception of goods not produced on the territory of the Republic of Kazakhstan;4) goods of the construction industry originating from foreign countries, with the exception of goods not produced on the territory of the Republic of Kazakhstan;5) goods of the furniture industry originating from foreign countries, with the exception of goods not produced on the territory of the Republic of Kazakhstan.

2. Allow individuals and legal entities listed in the register of Kazakhstani manufacturers to participate in public procurement.

3. The Ministry of Industry and Construction of the Republic of Kazakhstan, in coordination with the National Chamber of Entrepreneurs of the Republic of Kazakhstan “Atameken”, shall, within 10 working days from the date of adoption of this resolution, approve the list of goods provided for in paragraph 1 of this resolution, indicating the codes in accordance with the unified nomenclature reference book of goods, works, and services, and ensure that this list is submitted to the authorized body for public procurement.

4. This resolution comes into force ten calendar days after the date of its first official publication and remains in effect for two years.
