Article 629-5. The structure and content of the conviction in the order of writ proceedings of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. The introductory part of the indictment states:
1) that the verdict was passed in the name of the Republic of Kazakhstan;
2) the time and place of the verdict;
3) the name of the court that issued the verdict;
4) the defendant's surname, first name and patronymic (if any), year, month, day and place of birth, place of residence, place of work, occupation, education, marital status and other information about the defendant's identity relevant to the case;
5) a criminal law providing for a criminal offense of which the defendant is accused (article, part, paragraph).
2. The descriptive and motivational part of the indictment states:
1) a description of the criminal offense committed, in which the defendant is found guilty;
2) qualification of a criminal offense;
3) the form of guilt, the motives and consequences of the criminal offense, the nature and extent of the damage caused;
4) the motives for imposing a fine on the defendant;
5) reasons for the decision on the civil claim;
6) the fate of physical evidence, recovery of procedural costs.
3. The operative part of the indictment must specify:
1) the surname, first name and patronymic (if any) of the defendant;
2) the decision to find the defendant guilty of committing a criminal offense;
3) the criminal law (article, part, paragraph) according to which the defendant was found guilty;
4) the amount of the fine, including the final amount of the fine imposed on the basis of Article 58 of the Criminal Code of the Republic of Kazakhstan for each criminal offense with a combination of misconduct and (or) minor crimes;
4-1) the decision to deprive the defendant of the right to hold a certain position or engage in a certain activity;
5) the decision on the civil claim;
6) resolving the issue of physical evidence;
7) the decision on the distribution of procedural costs;
8) an indication of the procedure and time limit for filing a motion of disagreement with the verdict and appealing the verdict.
