Article 629-6. Sending a copy of the conviction in the order of writ proceedings of the CPC of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan
1. A copy of the indictment in the order of writ proceedings shall be sent by the court to the convicted person with a notification of delivery, to his defense attorney (with his participation), to the victim and the prosecutor, as well as to other participants in the process, within the same period from the date of receipt of the relevant petition.
2. The convicted person has the right, within seven days from the date of receipt of a copy of the guilty verdict, to send to the court that issued the verdict in the order proceedings, a petition for disagreement with the verdict, with the exception of the amount of the fine.
If a motion of disagreement with the sentence is received from the convicted person within the prescribed period, the judge cancels the sentence he handed down by writ and returns the case to the prosecutor, on which he issues a decision.
Upon receiving the criminal case, the prosecutor sends it to the pre-trial investigation body for further investigation.
A copy of the decision to annul the sentence passed in the order of writ proceedings is handed over (sent) to the convicted person, his defense attorney (with his participation), the victim and the prosecutor on the day of its delivery, as well as to other participants in the process – within the same period from the moment of receipt of the relevant petition.
The decision to annul the sentence by writ is not subject to appeal or review at the request of the prosecutor.
