Article 93. Foreclosure on wages and other types of income of the debtor of the Law on Enforcement Proceedings and the Status of Bailiffs
1. The collection of wages and other types of income of the debtor is applied in the execution of an enforcement document on the collection of periodic payments, in the recovery of an amount not exceeding one hundred monthly calculation indices, as well as for other penalties in the absence of the debtor's property or insufficient property to fully repay the amounts being collected.
2. When foreclosing on wages and other types of income of the debtor, the bailiff, taking into account the requirements of this Law, issues a resolution indicating the amount to be withheld monthly until the amounts awarded are fully recovered, and sends it, along with a copy of the enforcement document stamped by the territorial department or a private bailiff, for execution to the employer with whom the debtor is in an employment relationship, or the person from whom the debtor receives income.
3. The bailiff is obliged to monitor the correctness and timeliness of deductions from the debtor's salary and other income, as well as the timely transfer of the withheld amounts to the recoverer.
4. Upon dismissal of the debtor, the employer with whom he was in an employment relationship, or the person from whom the debtor received income, is obliged to send a notice to the bailiff within three days.
