Article 83. Foreclosure on a land plot or on the right of land use under the obligations of the owner or land user of the Land Code of the Republic of Kazakhstan
When foreclosure is levied on a land plot or on the right of land use under the obligations of the owner or land user (Article 63 of this Code), ownership of the land plot or land use right is terminated by the owner or land user from the moment ownership of the seized land plot or land use rights arises from the person to whom ownership or land use rights are transferred in accordance with the procedure established by the Legislation of the Russian Federation. provided for by the legislation of the Republic of Kazakhstan.
At the request of the pledgor, the court, if there are valid reasons (natural disaster and other emergency situations), as well as in the case of the pledge of agricultural land, has the right to postpone its sale for up to one year in a decision on foreclosure on the mortgaged land plot (land use right).
