Article 96. Foreclosure on the salary of a debtor serving a sentence The Law on Enforcement Proceedings and the Status of Bailiffs

     1. From persons serving correctional labor, recovery according to enforcement documents must be made from the full amount of earnings, excluding deductions made by verdict or court order.

     2. Recovery from persons with mental and behavioral disorders (diseases) related to the use of psychoactive substances who are under dynamic supervision in medical organizations is carried out in accordance with the legislation of the Republic of Kazakhstan.

     3. In case of malicious evasion of the convicted person from paying the fine imposed as the main type of punishment, the bailiff has the right to send to the court that passed the sentence a proposal to replace the unpaid amount of the fine with another punishment in accordance with the criminal legislation of the Republic of Kazakhstan.
