Article 222. Foreclosure on a share in the common property of the Civil Code of the Republic of Kazakhstan
1. The creditor of a participant in shared or joint ownership, if the latter has insufficient other property, has the right to demand that the debtor's share of the common property be allocated for foreclosure.
2. In cases where the other participants in the common ownership refuse to acquire the debtor's share, the creditor has the right to demand foreclosure on the debtor's share in the right of common ownership by selling this share at public auction.
3. If in such cases it is impossible to allocate a share in kind, or the other participants in shared or joint ownership object to this, the creditor has the right to demand that the debtor sell his share to the other participants in common ownership at a price commensurate with the market value of this share, with the proceeds from the sale being used to repay the debt.
