Article 95. The amount of deductions from wages and other types of income of the debtor of the Law on Enforcement Proceedings and the Status of Bailiffs

1. When foreclosing on the debtor's wages or other types of income according to one or more enforcement documents, including those in the production of other bailiffs, the debtor must retain at least fifty percent of the salary or other income.

     At the same time, the amount retained by the debtor must be at least the minimum subsistence level established annually for the relevant financial year by the law on the republican budget, except in cases of recovery of alimony and compensation for damage caused by injury or other damage to health, as well as the death of the breadwinner.

     This paragraph does not apply to persons serving a custodial sentence.

     2. Excluded by the Law of the Republic of Kazakhstan dated 04/27/2012 No. 15-V (effective after ten calendar days after its first official publication).

     3. If there are several resolutions on the foreclosure of wages and other types of income in respect of one debtor, a proportional distribution of the collected amounts is carried out according to enforcement documents in compliance with the requirements of Articles 110-111 of this Law.
