In accordance with subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan "On State and Socially Responsible Services", I ORDER:

1. To approve the attached rules for the provision of public services "Issuance of permits for the removal of fish and other aquatic animals, the number of which is subject to regulation" in accordance with the annex to this order.

2. The Committee of Fisheries of the Ministry of Agriculture of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) posting of this order on the Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. Control over the execution of this order is entrusted to the supervising Vice Minister of Agriculture of the Republic of Kazakhstan.

4. This order will enter into force on July 12, 2026 and is subject to official publication.

Regulations for the public service "Issuance of permits for the removal of fish and other aquatic animals, the number of which is subject to regulation"

Chapter 1. General provisions

1. These Rules for the provision of public services "Issuance of permits for the removal of fish and other aquatic animals, the number of which is subject to regulation" (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan "On State and Socially Responsible Services" (hereinafter referred to as the Law) and determine the procedure for the provision of public services "Issuing permits for the removal of fish and other aquatic animals, the number of which is subject to regulation" (hereinafter referred to as the state service).

2. The following basic concepts are used in the Rules:

1) the authorized body in the field of fisheries (hereinafter referred to as the authorized body) is the central executive body responsible for the protection, reproduction and use of fish resources and other aquatic animals, as well as inter–sectoral coordination within its powers.;

2) the digital government web portal (hereinafter referred to as the portal) is a digital object that provides a "single window" of access to consolidated information posted by government agencies and other entities involved in the provision of public services, including the regulatory legal framework, as well as to government and other services provided in electronic form.;

3) an electronic digital signature (hereinafter referred to as EDS) is a set of electronic digital symbols created by means of an electronic digital signature and confirming the authenticity of an electronic document, its affiliation and the immutability of its content.

Chapter 2. The procedure for the provision of public services "Issuance of permits for the removal of fish and other aquatic animals, the number of which is subject to regulation"

Paragraph 1. Procedure for the provision of public services

3. The state service is provided by the interregional basin fisheries inspectorate of the Committee of Fisheries of the Ministry of Agriculture of the Republic of Kazakhstan (hereinafter referred to as the service provider) to individuals and legal entities.

4. In order to receive a public service, the service recipient submits to the service provider an application for permission to remove fish and other aquatic animals, the number of which is subject to regulation in accordance with Annex 1 to the Rules through the portal.

The list of basic requirements for the provision of public services, including the grounds for refusal and the result of the provision of public services, as well as other information, taking into account the specifics of the provision of public services, is set out in Appendix 2 to the Rules (hereinafter referred to as the List).

When a service recipient submits an application through the portal, the "personal account" of the service recipient displays the status of acceptance of the application for the provision of public services, as well as a notification indicating the date and time of receipt of the result of the public service.

The service provider receives a certificate of registration (re-registration) of a legal entity, information about the registration of an individual entrepreneur, or about the start of activity as an individual entrepreneur, or a document certifying the identity of an individual from state digital systems through the digital government gateway.

Information interaction between the portal and digital systems is carried out in accordance with Article 83 of the Digital Code of the Republic of Kazakhstan.

When submitting an application, the service recipient consents to the use of information constituting a legally protected secret contained in digital systems in the provision of public services, unless otherwise provided by the laws of the Republic of Kazakhstan.

5. On the day of receipt of the application for permission to remove fish and other aquatic animals, the number of which is subject to regulation (hereinafter referred to as the application), the service provider's office receives and registers them in the digital system "State Database "E–Licensing" (hereinafter referred to as GBD "E-Licensing") and sends them to the service provider for consideration..

If the service recipient applies after the end of working hours, on weekends and holidays, according to the Labor Code of the Republic of Kazakhstan, documents are accepted on the following business day.

6. If the grounds for refusal provided for in paragraph 10 of the List are identified, the service provider issues a reasoned refusal to provide public services in accordance with Annex 4 to the Rules and sends it through the portal to the "personal account" of the GBD "E-Licensing" service recipient in the form of an electronic document signed by the EDS of the head of the service provider.

7. When a service recipient provides a complete package of documents, an employee of the responsible department reviews them for compliance with the requirements of the Rules within 1 (one) business day and issues a permit for the removal of fish and other aquatic animals, the number of which is subject to regulation (hereinafter referred to as the permit) in accordance with Appendix 3 to the Rules.

8. The result of the provision of public services is sent through the portal to the "personal account" of the service recipient in the "E-licensing" in the form of an electronic document certified by the EDS of the head of the service provider.

9. The service provider ensures that data is entered into the digital monitoring system for the provision of public services on the stage of provision of public services in accordance with the procedure established by the Order of the Acting Minister of Transport and Communications of the Republic of Kazakhstan dated June 14, 2013 No. 452 "On Approval of the Rules for Entering Data into the information system for monitoring the provision of public services on the stage of provision of public services" (registered in the Register of State registration of regulatory legal acts under No. 8555).

The authorized body shall send information about the changes and/or additions to the Rules to the operator of the digital infrastructure of the digital government, as well as to a Single Contact Center, within 3 (three) business days.

Paragraph 2. Procedure for appealing decisions, actions (inaction) of the service provider and (or) its officials on the provision of public services

10. A complaint against the decision, action (inaction) of the service provider on the provision of public services is submitted to the head of the service provider or to the authorized body for the assessment and control of the quality of public services.

If a complaint is received in accordance with the procedure established by Article 91 of the Administrative Procedural Procedure Code of the Republic of Kazakhstan (hereinafter referred to as the CPC RK), the service provider sends it to the body reviewing the complaint within 3 (three) business days from the date of receipt. The complaint will not be sent to the body considering the complaint if a favorable act is adopted or an administrative action is performed that fully satisfies the requirements specified in the complaint.

11. The complaint of the service recipient in accordance with paragraph 2 of Article 25 of the Law is subject to consideration.:

by the service provider, department of the authorized body, authorized body – within 5 (five) business days from the date of its registration;

by the authorized body for the assessment and control of the quality of public services – within 15 (fifteen) working days from the date of its registration.

12. In accordance with paragraph 4 of Article 25 of the Law, the period for consideration of a complaint by the service provider, the department of the authorized body, the authorized body, the authorized body for assessment and quality control of public services is extended for no more than 10 (ten) working days, if necessary.:

1) conducting additional investigation or verification of the complaint or on-site verification;

In case of extension of the time limit for consideration of the complaint, the official authorized to consider complaints, within 3 (three) business days from the date of extension of the time limit for consideration of the complaint, informs the recipient of the complaint in writing (when filing a complaint on paper) or electronically (when filing a complaint electronically) about the extension of the time limit. consideration of the complaint, indicating the reasons for the extension.

13. Unless otherwise provided by law, an appeal to the court is allowed after a pre-trial appeal in accordance with paragraph 5 of Article 91 of the CPC RK.
