On the Ratification of the Protocol on the Prohibition of the Use of Asphyxiating, Poisonous or Other Similar Gases and Bacteriological Agents in War

      To ratify the Protocol on the Prohibition of the Use of Asphyxiating, Poisonous or Other Similar Gases and Bacteriological Agents in War, signed in Geneva on June 17, 1925.

Protocol on the Prohibition of the Use of Asphyxiating, Poisonous or Other Similar Gases and Bacteriological Agents in War    

     (Entered into force on April 20, 2020, Bulletin of International Treaties of the Republic of Kazakhstan 2020, No. 4, Article 17)

      The undersigned Plenipotentiaries, on behalf of their respective Governments:  

     Considering that the use of suffocating, poisonous or other similar gases in war, as well as any similar liquids, substances and processes, has been justly condemned by the public opinion of the civilized world; and

     Considering that the prohibition of their use has been formulated in treaties to which most of the Powers of the world are parties; and

      In order to universally recognize this prohibition as incorporated into international law, which is equally binding on the conscience and practice of peoples.;  

      DECLARE:  

      That the High Contracting Parties, since they are not yet parties to treaties prohibiting this use, recognize this prohibition, agree to extend this prohibition to bacteriological warfare agents and agree to consider themselves bound to each other by the terms of this declaration.  

      The High Contracting Parties will make every effort to encourage other States to accede to this Protocol. The Government of the French Republic will be notified of this accession, and all signatory and acceding Powers will be notified last. The accession will take place from the date of notification by the Government of the French Republic.  

      This Protocol, of which the French and English texts will be considered authentic, will be ratified as soon as possible. It will bear the date of this day.  

      The instrument of ratification of this Protocol will be transmitted to the Government of the French Republic, which will immediately notify each signatory or acceding Power of its acceptance.  

      The instruments of ratification or accession to this Protocol will be kept in the archives of the Government of the French Republic.  

      This Protocol will enter into force for each signatory Power on the date of deposit of the instrument of ratification, and from that date each Power will be bound in respect of other Powers that have already deposited their ratifications.  

     In witness whereof, the Commissioners have signed this Protocol.

     Done at Geneva, in one copy, on the seventeenth of June, one thousand nine hundred and twenty-five.

     In witness whereof, the plenipotentiaries have signed this Protocol.
