Article 10. Electoral bodies, their system and term of office of the Constitutional Law on Elections in the Republic of Kazakhstan
1. The state electoral bodies organizing the preparation and conduct of elections in the Republic are election commissions.
2. The unified system of election commissions consists of:
1) The Central Election Commission of the Republic;
2) territorial election commissions;
2-1) district election commissions;
3) excluded by the Constitutional Law of the Republic of Kazakhstan dated 06/29/2018 No. 162-VI (effective ten calendar days after the date of its first official publication);
4) precinct election commissions.
3. Territorial and district election commissions for the election of deputies to the Mazhilis of Parliament are formed by the Central Election Commission, and district election commissions for the election of deputies to maslikhats and precinct election commissions are formed by the relevant territorial election commissions.
If the boundaries of districts in single-mandate territorial electoral districts coincide with the boundaries of administrative territorial units, district election commissions are not established, their powers are exercised by territorial election commissions.
The composition of election commissions, with the exception of the Central Election Commission, is formed by the respective maslikhats.
The term of office of election commissions is five years.
Members of territorial, district and precinct election commissions are elected by the respective maslikhats on the basis of proposals from political parties.
Each political party has the right to submit one candidate to the relevant election commission. A political party has the right to submit candidates to the election commission who are not members of this political party.
In the absence of proposals from political parties within the time limit set by the maslikhat, which must be at least fifteen days before the formation of election commissions, maslikhats elect an election commission on the proposal of other public associations and higher-level election commissions.
The persons proposed to the election commission shall attach statements of consent to participate in its work. The Chairman, Deputy Chairman, and secretary of the election commission are elected at a meeting of the election commission.
Members of territorial election commissions elected by maslikhats must meet the qualification requirements approved by the Central Election Commission.
The formation of a new composition of election commissions begins no later than two months and ends no later than three days before the end of the term of office of election commissions.
The bodies forming the composition of election commissions have the right to make changes to their composition during the term of office of election commissions.
4. Decisions on the formation of the composition of election commissions, their composition and location are reported in the mass media.
5. Decisions of election commissions taken within their competence are binding on all state bodies, organizations, local self-government bodies, as well as their officials in the relevant territory.
6. Interference in the activities of election commissions in the exercise of their powers is prohibited.
7. The activity of an election commission may be terminated by a decision of the body forming the election commission or by a court decision based on an application from the Central Election Commission.
8. A member of the election commission may not be deprived of his/her powers, except in the cases specified in paragraphs 6 and 7 of Article 19 of this Constitutional Law.
