Article 1074. The right to renounce inheritance of the Civil Code of the Republic of Kazakhstan

Article 1074. The right to renounce inheritance of the Civil Code of the Republic of Kazakhstan

     1. The heir has the right to renounce the inheritance within six months from the date of the opening of the inheritance. If there are valid reasons, this period may be extended by the court, but not for more than two months.

     2. The renunciation of the inheritance is made by submitting an application by the heir to the notary at the place of opening the inheritance.

     Renunciation of inheritance through a representative is possible if the power of attorney specifically provides for the authority to refuse.

     3. The renunciation of inheritance cannot be subsequently cancelled or taken back.

     4. The heir shall lose the right to renounce the inheritance upon the expiration of the period granted to him for this purpose. He also loses this right before the expiration of the specified period, if he actually took possession of the inheritance property or disposed of it, or applied for documents certifying his rights to this property.

     5. When renouncing an inheritance, the heir has the right to indicate that he renounces it in favor of other persons from among the heirs according to the will or according to the law of any turn, including in favor of those who are called upon to inherit by right of representation.

     Renunciation of inheritance in favor of heirs deprived of inheritance by the testator is not allowed.

     6. If an heir is called upon to inherit both by will and by law, he has the right to renounce the inheritance due to him on one of these grounds or on both grounds.

     7. The heir has the right to renounce the inheritance due to him by right of increment (Article 1079 of this Code), regardless of the inheritance of the rest of the inheritance.

     8. With the exception of the cases provided for in this article, renunciation of a part of the inheritance, renunciation of inheritance with reservations or under conditions is not allowed.
