1. Aircraft traveling from the place of crossing the State Border to checkpoints and back, as well as during transit through the airspace of the Republic of Kazakhstan, are required to comply with the following requirements of the Armed Forces of the Republic of Kazakhstan and the authorized body in the field of civil aviation of the Republic of Kazakhstan:

1) change course if it leads to a restricted or temporarily dangerous area for flights;

2) to inform about the purposes of entry into the airspace of the Republic of Kazakhstan or the reasons for deviation from the flight plan;

3) land at the specified location.

2. Aircraft traveling from the State Border to checkpoints or in the opposite direction, as well as transit flight through the airspace of the Republic of Kazakhstan, are prohibited, with the exception of natural disasters, disasters, accidents, emergencies and other cases threatening human life or health.:

1) landing (departure) at airports or airfields that are not international, not specified in the flight plan, as well as outside airports and airfields;

2) deviation from the established (recommended) corridors and routes, overflight of restricted areas and restricted flight zones published in aeronautical information documents;

3) disembarkation (boarding) of people, unloading (loading) of any cargo and goods.

Subparagraph 3) of this paragraph does not apply to cases of crossing the State Border specified in paragraph 4 of this article.

3. In exceptional cases, when performing international flights related to the performance of technical, emergency landings and humanitarian flights, as well as government tasks, aircraft landings and departures are carried out from airports or airfields that are not international. These flights are performed subject to a temporary permit issued by authorized bodies in the fields of civil and state aviation in coordination with the National Security Committee of the Republic of Kazakhstan, state revenue authorities of the Republic of Kazakhstan and other government agencies.

Kazakhstani aircraft delivering people, cargo and goods from the territory of the Republic of Kazakhstan to artificial islands, installations and structures, floating drilling rigs, including floating hotels located in the water space above the continental shelf, or from said artificial islands, installations and structures, floating drilling rigs, including floating hotels, to the territory of the Republic of Kazakhstan Citizens of Kazakhstan may repeatedly cross the State Border outside the designated air corridors without passing through border and other types of control in accordance with the Kazakhstani aircraft delivering people, cargo and goods from the territory of the Republic of Kazakhstan to artificial islands, installations and structures, floating drilling rigs, including floating hotels located in the water space above the continental shelf, or from said artificial islands, installations and structures, floating drilling rigs, including floating hotels, to the territory of the Republic of Kazakhstan Citizens of Kazakhstan may repeatedly cross the State Border outside the designated air corridors without passing through border and other types of control in accordance with the procedure established by the Legislation of the Republic of Kazakhstan., established by the Government of the Republic of Kazakhstan. These Kazakhstani aircraft are prohibited from entering the airspace of foreign states, boarding (boarding) persons who have passed border control upon departure from the territory of the Republic of Kazakhstan, as well as persons who have not passed border control upon arrival in the territory of the Republic of Kazakhstan, loading (unloading) any cargo, goods, currency, animals on ships. (from ships), in respect of which border and customs control has been carried out upon departure from the territory of the Republic of Kazakhstan, as well as on ships (from ships), in respect of which border and customs control has not been carried out upon arrival on the territory of the Republic of Kazakhstan, except in cases when this is caused by the need to rescue people, ships or other extraordinary circumstances, about which the commander of the Kazakh aircraft immediately informs the Border Guard Service of the National Security Committee of the Republic of Kazakhstan, as well as authorized bodies in the field of civil and state aviation.

Customs operations related to the arrival (departure) of vessels, in the case specified in the first part of this paragraph, are carried out in accordance with the customs legislation of the Republic of Kazakhstan.

This Law regulates public relations in the field of protection of the State border of the Republic of Kazakhstan.
