Article 171. Compulsory medical measures against a person with mental and behavioral disorders (diseases) related to the use of psychoactive substances Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan

Article 171. Compulsory medical measures against a person with mental and behavioral disorders (diseases) related to the use of psychoactive substances Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan

     1. Compulsory medical measures are applied by a court decision against a person with mental and behavioral disorders (diseases) related to the use of psychoactive substances who has committed a criminal offense and is recognized as needing treatment, as well as against a person who has committed an administrative offense and is evading voluntary treatment.

     2. Referral for compulsory treatment to organizations providing medical care in the field of mental health to persons with mental and behavioral disorders (diseases) does not entail a criminal record.

     The time spent on compulsory medical treatment does not interrupt the length of service and is counted in the total length of service.

     3. For a person sent for compulsory medical treatment, who lives in a dwelling from the state housing stock, housing is maintained during the entire time of treatment.

     4. A person with a mental or behavioral disorder (disease) related to the use of psychoactive substances who is undergoing compulsory treatment has the right:

     1) to get acquainted with the internal regulations of the organization for compulsory medical treatment and other documents regulating the order of stay in this organization;

     2) correspondence, receipt and dispatch of parcels, parcels, money, postal orders, telephone use, reception of visitors, subscription to periodicals;

     3) receive food, household and medical care;

     4) for employment in accordance with the labor legislation of the Republic of Kazakhstan;

     5) purchase food and basic necessities, as well as other items that are not prohibited for storage and use on the territory of the organization for compulsory medical treatment, at the expense of funds held in a personal personal account.;

     6) have meetings with close relatives in accordance with the procedure established by the internal regulations;

     7) conduct correspondence without restrictions;

     8) receive transfers, send and receive parcels in accordance with the procedure established by the internal regulations;

     9) receive money transfers that are credited to his personal account;

     10) for a daily walk;

     11) to file complaints about actions (inaction) employees of organizations to the authorized body, the prosecutor's office, the court in accordance with the procedure established by the laws of the Republic of Kazakhstan.

     5. A person with a mental or behavioral disorder (disease) related to the use of psychoactive substances who is undergoing compulsory treatment in an organization must:

     1) comply with the established internal regulations;

     2) comply with the legal requirements of the organization's administration for compulsory medical treatment and medical personnel;

     3) take the prescribed treatment;

     4) take good care of the organization's property;

     5) to maintain cleanliness and order in the organization for compulsory medical treatment, as well as to carry out cleaning on its territory no more than two hours a week;

     6) observe personal hygiene.
