Article 98. Compulsory medical measures connected with the execution of punishment of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1. In the case provided for in paragraphs 3) and 5) of the first part of Article 91 of this Code, compulsory medical measures are carried out at the place of imprisonment, and in respect of persons sentenced to other types of punishment – in health care organizations providing outpatient psychiatric care.
2. In the case provided for in paragraph 4) According to the first part of Article 91 of this Code, compulsory medical measures are carried out at the place of serving imprisonment, and in relation to those sentenced to other types of punishment – in healthcare organizations.
3. In case of a change in the mental state of a convicted person requiring inpatient treatment, the convicted person is placed in a psychiatric hospital or other medical institution in accordance with the procedure and on the grounds provided for by the legislation of the Republic of Kazakhstan in the field of healthcare.
4. The time spent in these institutions is counted towards the term of serving the sentence. If there is no need for further treatment of the convicted person in these institutions, discharge is carried out in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan in the field of healthcare.
5. The termination of the application of a compulsory medical measure combined with the execution of punishment is carried out by the court on the recommendation of the body executing the punishment, based on the conclusion of a commission of psychiatrists.
