Article 91. Grounds for the use of compulsory medical measures of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1 Compulsory medical measures may be imposed by a court on persons:
1) who committed the acts provided for in the articles of the Special Part of this Code in a state of insanity;
2) who, after committing a criminal offense, have a mental disorder that makes it impossible to impose or execute punishment;
3) those who have committed a criminal offense and suffer from mental disorders that do not exclude sanity;
4) who have committed a criminal offense and are recognized as needing treatment for mental and behavioral disorders (diseases) related to the use of psychoactive substances;
5) over eighteen years of age, who have committed a criminal offense against the sexual integrity of minors.
2 Compulsory medical measures shall be prescribed to the persons specified in the first part of this article only in cases where mental disorders are associated with the possibility of these persons causing other significant harm or with danger to themselves or others.
3 The procedure for the execution of compulsory medical measures shall be determined by The Penal Enforcement Code and the legislation of the Republic of Kazakhstan in the field of healthcare.
4 In respect of persons specified in paragraphs 1) – 4) of the first part of this article who do not pose a danger due to their mental state, the court may transfer the necessary materials to the health authorities to resolve the issue of treating these persons or sending them to neuropsychiatric organizations in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan in the field of healthcare.
