Commentary to article 312. Consideration of cases on the use of compulsory medical measures The Criminal Procedure Code of the Republic of Kazakhstan
Cases on the application of compulsory medical measures to persons who have committed an act prohibited by criminal law in a state of insanity or who have become mentally ill after its commission shall be considered by the court of first instance in accordance with the jurisdiction established by Articles 306, 307, 308 and 309 of this Code.
All criminal cases, regardless of their subject matter, in which decisions have been made to refer the criminal case to the court to resolve the issue of the use of compulsory medical measures, are considered by the courts of first instance in accordance with their jurisdiction.
