Article 170. Compulsory medical measures against a person with mental and behavioral disorders (diseases) The Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan

Article 170. Compulsory medical measures against a person with mental and behavioral disorders (diseases)   The Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan

  1. Compulsory medical measures are applied by a court decision against a person with a mental or behavioral disorder (disease) who has committed socially dangerous acts, on the grounds and in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     2. Compulsory medical measures are carried out in organizations providing medical care in the field of mental health to persons with mental, behavioral disorders (diseases), in the form of:

     1) compulsory observation and treatment by a psychiatrist on an outpatient basis;

     2) compulsory treatment in a psychiatric hospital of a general type;

     3) compulsory treatment in a specialized psychiatric hospital;

     4) compulsory treatment in a specialized psychiatric hospital with intensive supervision.

     3. A person who has been placed in a hospital for the application of compulsory medical measures shall be deemed incapacitated for the entire period of stay in the hospital.

     4. The rules for the use of funds from individuals and legal entities, including pension payments and state social benefits, credited to the cash control account of a specialized state psychiatric organization with intensive supervision, for use by persons with mental and behavioral disorders (diseases) undergoing compulsory treatment, are approved by the authorized body.

     5. Accounting and reporting on the use of funds from the cash control account of a specialized state psychiatric organization with intensive supervision, as well as control over their use, are carried out in accordance with the legislation of the Republic of Kazakhstan.

     6. The protection of an organization providing medical care in the field of mental health in the form of compulsory treatment of persons with mental and behavioral disorders (diseases) caused by the use of psychoactive substances is entrusted to the administration of this organization and is carried out in accordance with the legislation of the Republic of Kazakhstan in the field of security activities.

     7. The protection of a specialized state psychiatric organization with intensive supervision is carried out in accordance with the procedure determined by the Ministry of Internal Affairs of the Republic of Kazakhstan jointly with the authorized body.

     8. The equipment of the state psychiatric organization of a specialized type with intensive supervision by engineering and technical means of protection is carried out by the authorized body in accordance with the procedure determined by the Ministry of Internal Affairs of the Republic of Kazakhstan jointly with the authorized body.
