Article 603. Conditions for the transfer of a convicted person or a person to whom compulsory medical measures have been applied CPC RK Code of Criminal Procedure of the Republic of Kazakhstan
1. The transfer of foreigners referred to in Article 602 of this Code is permitted until they have served their sentence of imprisonment or completed compulsory medical treatment at the request of the convicted person or the person to whom compulsory medical measures have been applied, their legal representatives or close relatives, as well as at the request of the competent authority of the relevant State with the consent of the convicted person or the person to whom compulsory medical measures have been applied compulsory medical measures, and in the case of his inability to freely express his will – with the consent of his legal representative.
2. The transfer of foreigners specified in Article 602 of this Code may be carried out only after the entry into force of a verdict or court order by decision of the Prosecutor General of the Republic of Kazakhstan or his deputy, who inform the court that issued the verdict or decision about the transfer.
