Article 55. The basis and procedure for termination of an employment contract in connection with the transfer of an employee to another legal entity of the Labor Code of the Republic of Kazakhstan
1. The employment contract with an employee is terminated due to his transfer to another legal entity.:
1) more than fifty percent of the shares (shares of participation in the authorized capital) of which are directly or indirectly owned by the employer with whom the employment contract is terminated;
2) who directly or indirectly owns more than fifty percent of the shares (shares of participation in the authorized capital) of the employer with whom the employment contract is terminated;
3) more than fifty percent of the shares (shares of participation in the authorized capital) of the specified legal entity and the employer with whom the employment contract is terminated belong to one legal entity.
1-1. An employment contract with a civil servant is terminated in connection with his transfer to work in another state institution or a state-owned enterprise if the requirements of paragraph 8 of Article 139 of this Code are fulfilled.
2. The grounds for termination of an employment contract are a written statement from the employee and a written confirmation of consent to be employed by another legal entity. The date of termination of the employment contract is determined by agreement of the parties.
