Article 670. Issues resolved by the court in the consultation room in proceedings on confiscation of the CPC of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan
1. The court, based on the results of consideration of the petition for confiscation, issues a decision.
2. When making a court decision, the following issues are resolved::
1) is the property of the suspect or accused related to the crime that is the basis for confiscation in the cases provided for in Article 48 of the Criminal Code of the Republic of Kazakhstan;
2) whether the property of a third party was acquired in the manner prescribed by Article 48 of the Criminal Code of the Republic of Kazakhstan;
3) is confiscation to be applied and to which part of the property it should be applied;
4) what should be done with the seized or seized property, which is not subject to confiscation;
5) what is the amount of the costs of the confiscation proceedings and to whom they are imposed.
