On the formation, reorganization and abolition of certain district and equivalent courts of the Republic of Kazakhstan
Decree of the President of the Republic of Kazakhstan dated September 9, 2004 No. 1437.
In accordance with paragraph 3 of Article 3, paragraph 1 of Article 6 of the Constitutional Law of the Republic of Kazakhstan dated December 25, 2000 "On the judicial system and the status of Judges of the Republic of Kazakhstan", I hereby decree:
1. To form judges within the staff approved by Decree of the President of the Republic of Kazakhstan dated January 22, 1999 No. 29 "On measures for further optimization of the system of state bodies of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1999, No. 1, art. 2; 2001, No. 4-5, art. 43; 2002, N 26, Article 272; No. 45, Article 445; 2003, No. 12, Article 130; No. 16, Article 160; 2004, No. 13, Article 166):
1) Specialized administrative courts :
cities of Kokshetau, Akmola region;
Shchuchinsky district of Akmola region;
cities of Aktobe, Aktobe region;
cities of Taldykorgan, Almaty region;
Atyrau cities of Atyrau region;
cities of Ust-Kamenogorsk, East Kazakhstan region;
Zyryanovsky district of East Kazakhstan region;
cities of Ridder, East Kazakhstan region;
cities of Semipalatinsk, East Kazakhstan region;
Shemonaikha district of East Kazakhstan region;
cities of Taraz, Zhambyl region;
cities of Uralsk, West Kazakhstan region;
Burlinsky district of West Kazakhstan region;
cities of Balkhash, Karaganda region;
cities of Zhezkazgan, Karaganda region;
cities of Temirtau, Karaganda region;
cities of Shakhtinsk, Karaganda region;
cities of Kostanay, Kostanay region;
cities of Rudny, Kostanay region;
Kyzylorda cities of the Kyzylorda region;
cities of Aktau, Mangystau region;
cities of Zhanaozen, Mangystau region;
cities of Pavlodar, Pavlodar region;
Aksu cities of Pavlodar region;
cities of Ekibastuz, Pavlodar region;
the cities of Petropavlovsk in the North Kazakhstan region;
Shymkent city, South Kazakhstan region;
Saryagash district of South Kazakhstan region;
2) specialized interdistrict administrative court of the city of Karaganda, Karaganda region.
2. The Qualification Board of Justice, the Minister of Justice, the Chairman of the Supreme Court of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, take measures to select candidates for the positions of chairmen and judges of courts formed in accordance with this Decree, and submit proposals on the staffing of these courts to the President of the Republic of Kazakhstan for consideration.
3. Reorganize district and equivalent courts by separating district and equivalent courts from them in accordance with Appendix 1.
4. Judges of the reorganized courts shall be considered judges of the courts formed in accordance with paragraph 3 of this Decree, in accordance with Appendix 2.
5. Abolish:
1) in the Akmola region:
District court No. 2 of the Zharkainsky district;
2) in the Karaganda region:
District court No. 2 of the Nurinsky district;
3) in Kostanay region:
District Court No. 2 of the Amangeldinsky district.
6. The Chairman of the Supreme Court of the Republic of Kazakhstan shall determine the territorial jurisdiction of cases for the courts specified in paragraph 3 of this Decree.
7. The Government of the Republic of Kazakhstan, the Supreme Court of the Republic of Kazakhstan, and the Committee on Judicial Administration under the Supreme Court of the Republic of Kazakhstan shall take the measures resulting from this Decree.
8. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.
9. This Decree comes into force from the date of signing.
