Article 43. Legal relations related to the law enforcement service, in case of staff reduction, reorganization or liquidation of the law enforcement agency of the Law Enforcement Service Act
1. When the staff of a law enforcement agency is reduced, legal relations with an employee filling a reduced position continue in the following cases::
1) providing an employee with the opportunity to fill another position in the same or in another law enforcement agency;
2) sending an employee for professional retraining, advanced training, or training in a law enforcement agency's educational organization.
1-1. In case of reorganization of a law enforcement agency, the management of the newly formed body offers a position to an employee of the reorganized body in accordance with his qualifications.
If an employee refuses the proposed position, he/she shall be dismissed in accordance with the procedure established by this Law.
2. Upon liquidation of a law enforcement agency, legal relations with an employee may be continued if the employee is given the opportunity to fill another position in the law enforcement agency to which the functions of the liquidated law enforcement agency have been transferred, or in another law enforcement agency.
3. In case of refusal of an employee from a position proposed for another position, he/she shall resign from the law enforcement service in accordance with the procedure established by this Law.

This Law regulates public relations related to admission to the law enforcement service of the Republic of Kazakhstan, its passage and termination, and also defines the legal status (status), financial support and social protection of law enforcement officers of the Republic of Kazakhstan.
