Article 245. State regulation of prices for medicines and medical devices Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan
1. State regulation of prices is carried out on:
1) medicines for wholesale and retail sale included in the list of medicines subject to price regulation for wholesale and retail sale;
2) medicines and medical devices within the guaranteed scope of free medical care and (or) in the system of compulsory social health insurance;
3) medical devices for diagnostics outside a living organism (in vitro), manufactured in the territory of the Republic of Kazakhstan under long-term supply agreements concluded with a single distributor.
The list of medicines subject to price regulation for wholesale and retail sale is approved by the authorized body.
2. The authorized body approves the manufacturer's prices and the marginal prices for the trade name of a medicinal product for wholesale and retail sale included in the list of medicines subject to price regulation for wholesale and retail sale.
3. The authorized body approves the maximum price for the trade name of a medicinal product or medical device within the framework of the guaranteed volume of free medical care and (or) in the system of compulsory social medical insurance, the maximum price for the international nonproprietary name of a medicinal product or the technical characteristics of a medical device within the framework of the guaranteed volume of free medical care and (or) in the system of compulsory social medical insurance. insurance.
4. The authorized body shall on an ongoing basis keep records and systematize the information specified in paragraphs 2 and 3 of this article in electronic form in chronological order, taking into account the changes made and preserving previous versions and providing open access to this information in electronic format. -Excluded by the Law of the Republic of Kazakhstan dated June 24, 2026 No. 321-VIII SAM
The information specified in paragraphs 2 and 3 of this article shall be kept for five years, starting from the year following the year of approval of the maximum prices for medicines.
5. The maximum retail price cannot be approved without observing the total wholesale and retail margins to the manufacturer's price.
6. The authorized body monitors and controls compliance with the maximum prices of medicines by trade names.
7. The wholesale and retail sale of medicinal products included in the list of medicinal products subject to price control for wholesale and retail sale is not allowed, without limiting the price of medicinal products by trade name.
