Article 52. State control in the sphere of circulation of medicines and medical devices Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan
1. State control in the field of circulation of medicines and medical devices is aimed at preventing, detecting, suppressing and eliminating violations of the legislation of the Republic of Kazakhstan in the field of healthcare and regulatory legal acts in the field of circulation of medicines and medical devices by the subjects of control.
2. Public health entities engaged in the sale of medicines and medical products, engaged in pharmaceutical activities, as well as legal entities engaged in quality control of raw materials, medicines and medical products, and a state expert organization in the field of circulation of medicines and medical products are subject to state control.
3. State control in the sphere of circulation of medicines and medical devices is carried out in the form of:
1) conducting inspections in accordance with the Business Code of the Republic of Kazakhstan;
2) conducting preventive control with a visit to the subject of control in accordance with the Business Code of the Republic of Kazakhstan;
3) carrying out preventive control without visiting the subject (facility) in accordance with this Code.
4) inspections conducted for compliance with the qualification or licensing requirements for permits issued, the requirements for notifications sent in accordance with the Law of the Republic of Kazakhstan "On Permits and Notifications";
5) investigations.
