Article 246. Purchase of medicines and medical devices intended for the provision of minimum, basic and additional volumes of medical care Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan

1. Medicines intended for the provision of minimum, basic and additional volumes of medical care are purchased under international nonproprietary names, and in case of individual patient intolerance – under trade names of medicines registered in the Republic of Kazakhstan, based on the conclusion of the medical advisory commission and the decision of the local representative body of the region, cities of republican significance and the capital.. In case of purchase of a multicomponent medicinal product, its composition is indicated.

2. In order to optimize and effectively spend the budget funds allocated for the purchase of medicines and medical devices within the guaranteed volume of free medical care and compulsory social health insurance funds, medicines and medical devices are purchased at prices not exceeding those established by the authorized body, with the exception of unregistered medicines and medical devices imported into the territory of the Republic of Kazakhstan. based on the conclusion (authorization document) issued by the authorized body.

3. The purchase of medicines and medical devices intended to provide a guaranteed amount of free medical care and (or) medical care in the compulsory social health insurance system is carried out in accordance with the procedure and methods established by the authorized body, including through the web portal for the purchase of medicines and medical devices, and the purchase of services from healthcare entities.

4. Subjects in the field of circulation of medicines and medical devices, including pharmacies with the right to manufacture medicines that have a certificate of compliance with the requirements, have a preferential right to conclude contracts within the framework of the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance.:

1) good manufacturing practice (GMP), when purchasing medicines and concluding long-term contracts for the supply of medicines;

2) good distribution practice (GDPR), in the procurement of medicines, pharmaceutical services and the conclusion of long-term contracts for the storage and transportation of medicines and medical devices;

3) good pharmacy practice (GRP), in the procurement of pharmaceutical services, services for the accounting and sale of medicines and medical devices.
