Article 292. Announcement of the search for the suspect, the accused CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. The search for a suspect or accused person involves taking measures to establish his location, detain him and transfer him to the disposal of the body conducting the pre-trial investigation.
A search may be declared against a suspect after a decision has been made on the qualification of his act, as well as against the accused.
The person conducting the pre-trial investigation issues a resolution on the search for the suspect, the accused, in which he indicates all the information known about their identity, the grounds for conducting a search, and entrusts the search to the bodies of inquiry.
2. If there are grounds specified in Article 136 of this Code, a preventive measure may be chosen in respect of a suspect or an accused person who is wanted. In the cases provided for in Article 147 of this Code, a preventive measure in the form of detention may be applied with the sanction of the investigating judge.
The decision on the choice of a preventive measure against the wanted person, as well as, in appropriate cases, a court decision on its authorization, are also sent to the body carrying out the search.
3. If a suspect or accused is identified, they may be detained in accordance with the procedure established by Article 131 of this Code.
4. If there are grounds for declaring an international wanted list, the criminal prosecution authority issues a separate resolution on declaring the suspect or accused internationally wanted.
The authorization of a resolution on the international wanted list is carried out in accordance with the procedure provided for in the second part of Article 56 of this Code.
