Article 607. Consideration of an application for admission of a citizen of the Republic of Kazakhstan to serve a sentence or undergo compulsory treatment, as well as recognition and enforcement of a sentence or a court order of a foreign state CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. Citizens of the Republic of Kazakhstan specified in Article 602 of this Code, their legal representatives, spouse or close relatives, as well as the competent authorities of a foreign state, with the consent of the convicted person or the person to whom compulsory medical measures have been applied, and in case of his inability to freely express his will – with the consent of his legal representative, They may apply to the Prosecutor General of the Republic of Kazakhstan with a request for the convicted person to serve his sentence or undergo compulsory medical treatment in the Republic of Kazakhstan.

     2. Competent institutions of a foreign state may apply to the Prosecutor General of the Republic of Kazakhstan with a request for recognition and enforcement of a sentence or a court order of a foreign state in respect of persons specified in paragraphs 3) and 4) of the first part of Article 601 of this Code, as well as judicial acts providing for the confiscation of property located in the territory of the Republic of Kazakhstan, or its monetary equivalent.

     3. After the Prosecutor General of the Republic of Kazakhstan has initiated an application for admission of citizens of the Republic of Kazakhstan specified in Article 602 of this Code for subsequent serving of a sentence or compulsory medical treatment in the Republic of Kazakhstan and confirmation of the citizenship of the Republic of Kazakhstan of this person, the Prosecutor General's Office of the Republic of Kazakhstan shall request from the relevant body of a foreign state the documents necessary to resolve the issue on the merits.

     4. In case of satisfaction of the petitions provided for in the first and second parts of this article, the Prosecutor General of the Republic of Kazakhstan submits a submission on the recognition and execution of a sentence or a court order of a foreign state to a district or equivalent court at the place of permanent residence of persons in respect of whom a sentence or a court order of a foreign state has been passed. If these persons do not have a permanent place of residence, the submission is submitted to the district court at the location of the General Prosecutor's Office of the Republic of Kazakhstan.
