Article 358. Violation of the requirements for the protection of water bodies and the water resources contained therein from pollution, clogging and depletion, as well as failure to take measures to prevent the harmful effects of waters of the Code of the Republic of Kazakhstan on Administrative Offenses
1. Violation of the requirements for the commissioning of facilities that adversely affect the condition of water bodies, –
entails a fine for individuals in the amount of one hundred and forty, for officials, small business entities or non–profit organizations – in the amount of two hundred and eighty, for medium–sized businesses - in the amount of four hundred and ninety, for large businesses - in the amount of nine hundred and eighty monthly calculation indices.
2. Failure to take measures defined by the water legislation of the Republic of Kazakhstan to protect water bodies from pollution, clogging and depletion, failure to rehabilitate surface water bodies, failure to implement an action plan to reduce water losses, gradual (no more than five years) transition to recycled and (or) re-water supply systems, the introduction of the best available technologies, and also, the failure to take measures to create engineering systems for the protection of settlements, industrial facilities, agricultural land, and transport infrastructure facilities, hazardous production facilities from floodwaters and meltwater and (or) their diversion and (or) redistribution to replenish reservoirs, lake systems and groundwater deposits, failure to reforest floodplain areas of surface water bodies –
they impose a fine on individuals in the amount of one hundred and forty, on officials, on small businesses or non–profit organizations – in the amount of two hundred and thirty–eight, on medium-sized businesses - in the amount of seven hundred, on large businesses - in the amount of nine hundred and eighty monthly calculation indices.
