Comment to article 333. Violation of the rules of protection of communication lines of the Criminal Code of the Republic of Kazakhstan of the Criminal Code of the Republic of Kazakhstan
Violation of the rules of protection of communication lines, which caused damage to the long-distance cable line, if it caused a break in communication, —
is punishable by a fine in the amount of one hundred to five hundred monthly calculation indices or in the amount of the convicted person's salary or other income for a period of one to five months or by arrest for up to three months.
Disruption of communication, especially in the case of international production cooperation, can cause significant economic losses. Automated control systems implemented in all branches of production can only function if communications are working flawlessly. The above indicates the public danger of damage to communication lines. The established procedure for the operation of long-distance cable communications should be recognized as an immediate object. The objective side of the crime is expressed in a violation of the rules of protection of the communication line, which caused damage to the long-distance cable line, if it caused a break in communication. The disposition of this article is blank. Specific rules for the protection of communication lines and the types of their violations are determined by a special law. According to According to the Law of the Republic of Kazakhstan "On Communications of the Republic of Kazakhstan" dated July 5, 2004, security zones and clearings of communication networks, which are zones with land use conditions, are established in order to ensure the safety of communication networks, the operation of technical facilities, structures and devices (art. 27). An example of criminal inaction may be such violations of the rules as failure to comply with the requirements for strengthening the soil, the performance of work by an official in a security zone without technical documentation, if this circumstance caused damage to the cable line and caused a break in communication. The disposition of Article 333 of the Criminal Code of the Republic of Kazakhstan refers to damage to long-distance cable lines. Intercity cables include cables laid between cities and other localities, unlike local communication lines. These are mainly multi-channel (from 60 to 3600 channels) systems. Intercity cables are laid both within the city and outside the city. A crime is considered over when a violation of the rules for the protection of communication lines has resulted in a break in communication. The subjective side of the crime presupposes both intentional and careless forms of guilt. The motive and purpose do not matter for qualification, but they are taken into account when assigning punishment. The subject of the crime can be both private and official sane individuals who have reached the age of 16.
