     – entails a warning or a fine in the amount of three monthly calculation indices.

     2. The same actions that caused damage to the health or property of individuals,

     – incur a fine in the amount of ten monthly calculation indices.

     The general object of the offense is the social relations developing in the field of veterinary and sanitary welfare of the administrative territories of the Republic of Kazakhstan. An optional object here may be the health of citizens or public safety, as the third part of the article explicitly defines the object of protection and the health and material well-being of individuals.

     The rules for keeping cats and dogs must be approved by local executive authorities, both in urban and rural areas. Since cats and dogs belonging to individuals are the instrument of committing an offense, the Rules should provide for measures to combat stray cats and dogs.

     It is prohibited to organize and conduct dogfights and other events that commit cruelty to animals on the territory of the city (the exception is checking the working qualities of dogs according to special rules, which excludes animal mutilation and allows for proper breeding selection for breeding guard dogs).

     Dogs can be leashed in muzzles and on short leashes, which exclude arbitrary untying, near buildings for the time during which the owners of the animals are in buildings, if there is no threat to other persons, violation of public order, movement and health of the dog. At the same time, dogs should not interfere with the passage of people and vehicles.

The rules for trapping and destroying stray cats and dogs are approved by local representative bodies on the basis of paragraphs 2-2 of Article 6 of the Law of the Republic of Kazakhstan dated January 23, 2001 "On Local Public Administration and Self-Government in the Republic of Kazakhstan". For example, when classifying such offenses, police officers of the Almaty region should be guided by the decision of the Maslikhat of the Almaty region dated March 27, 2015 No. 43-249 "On approval of the Rules for keeping and walking dogs and cats, trapping and destroying stray dogs and cats in the Almaty region."

     The objective side of part 2 of the commented article provides for damage to the health or property of individuals as a result of improper maintenance of cats or dogs. If, as a result of these illegal actions, property owned by a legal entity is damaged, then Article 408 of the Administrative Code cannot be applied in this case. Since the legislator overlooked these cases, compensation for property damage to a legal entity, which is possible only through civil proceedings.

     The subject of the offense will be a capable and sane owner of a dog or cat or a person responsible for their maintenance who has reached the age of 16 at the time of the offense.

     The subjective side of the commented article can be expressed in the form of direct intent, or by negligence.

     They have the right to initiate proceedings under the commented article and impose an administrative penalty.:

     1) chairmen of committees and heads of departments of the Ministry of Internal Affairs, heads of territorial internal affairs bodies, administrative divisions, migration police, local police service of the region, city of republican significance, capital, their deputies (paragraph 1, part 2, art. 685 of the Administrative Code);

     The sanction of part 1 of the commented article provides for two types of administrative penalties:

     1)Warning;

     2) a fine in the amount of three monthly calculation indices.

     But arbitrary choice of punishment is unacceptable. When making a decision to impose an administrative penalty under the commented article, the above-mentioned officials must take into account the requirements of part 2 of Article 43 of the Administrative Code, which states that "In the absence of circumstances provided for in Article 57 and the note to Article 366 of this Code, the court (judge), the body (official) imposing the administrative penalty is obliged to apply a warning provided for in the relevant article of the Special Part of this Code."

     That is, if there are no circumstances in the actions of the offender that aggravate responsibility for administrative offenses, then the official must issue a resolution imposing an administrative penalty in the form of a warning.
