comment_____________________________________________
A special regime for the use of land within roadside lanes is established to create operating conditions, maintain highways and their safety, ensure road safety and public safety, and ensure the possibility of their expansion during reconstruction in the future.
The title of the article under review provides for the existence of rules for the protection and use of right-of-way roads, which do not exist in the Republic of Kazakhstan and have never been adopted. In this regard, it is justified that the word "security rules" in the title of the article should be changed to the word "security requirements".
The general object of the offense is social and legal relations in the field of road safety. The generic object of the administrative offense being commented on is the social relations that arise in the process of protecting and using the right-of-way.
The objective side of part 1 of the commented article is expressed by the following qualifying features in the form:
1) the commission of illegal actions committed in the right-of-way lane without approval in accordance with the established procedure:
- plowing of land reserves;
- cutting down of plantings;
- uprooting and damage to plantings;
- removal of turf and excavation;
- storage of materials and cargo;
- production of topographic and other works;
- equipment of intersections and entrances;
- construction of structures, underground and surface buildings
- construction of communications;
- installation of advertising and other information.
2) the commission of illegal actions committed within the right-of-way in the form of:
- making a fire;
- cattle grazing;
- landfills of garbage and snow;
- trading outside the designated locations.
3) discharge of sewage, industrial, reclamation and waste water into the road drainage system;
4) the use of road ditches as sprinklers.
All of the above illegal actions may exist separately or in combination with each other when qualifying the commented offense.
According to the rules of the road, a road is the entire strip of land or the surface of an artificial structure, equipped or adapted and used for the movement of vehicles and pedestrians in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Road Traffic" and these Rules.
The operation procedure of the right-of-way is regulated by Article 9 of the Law of the Republic of Kazakhstan dated July 17, 2001 No. 245 "On Highways". The lands of the right-of-way for public roads are owned and used by road authorities or other persons and are intended only for the development, improvement of highways and ensuring their safety.
It is prohibited to build buildings and structures, as well as to lay engineering communications within the right-of-way along a public highway, with the exception of road service facilities, outdoor (visual) advertising, traffic police posts, sanitary and epidemiological control, customs, border, transport control, veterinary and phytosanitary control posts.
Land plots of the right-of-way for public roads that are not used by the road authority, the National Operator or other highway managers in accordance with the procedure established by the legislation of the Republic of Kazakhstan may be provided for temporary short-term land use under a contract to individuals and legal entities for outdoor (visual) advertising, provided that the road's transport and operational qualities are not reduced, and the requirements of traffic safety and environmental protection:
1) in the right–of-way of public roads of international and national significance - by the authorized state agency for highways;
2) in the right–of-way of public roads of regional or district significance - by the local executive body of the region or district.
The actions listed in the first qualifying feature of the commented article may be carried out by prior agreement with the owner of the highway in accordance with the Order of the Minister of Investment and Development of the Republic of Kazakhstan dated December 29, 2015 No. 1267 "On approval of the Rules for the use of highways, roads of defense significance."
The objective side of part 2 of the article under consideration is characterized by the presence of qualifying signs specified in Part 1 of Article 633 of the Administrative Code, entailing the onset of a socially dangerous consequence, namely, a traffic accident causing minor harm to human health, damage to vehicles, cargo and other property.
The concept of a traffic accident is given by subparagraph 29 of paragraph 2 of the Traffic Rules. A traffic accident is an event that occurred during the movement of a vehicle along the road and with its participation, resulting in injury to health, death of a person, damage to vehicles, structures, goods, or other material damage.
The amount of material damage does not matter for the qualification of an offense. Compensation for damages is possible on a voluntary basis, which will be an extenuating circumstance when making a decision on the case.
The severity of harm to health is determined in accordance with the Order of the Minister of Justice of the Republic of Kazakhstan dated April 27, 2017 No. 484 "On approval of the Rules for the organization and conduct of forensic examinations and research in forensic examination bodies". An examination of the severity of the damage to health can be carried out based on medical documents (inpatient patient's card, outpatient patient's card and other medical documents) if there is a complete package of documents containing comprehensive data on the nature of the damage and its clinical course.
The subjects of all parts of the commented offense are users of highways, namely individuals, as well as legal entities in the form of small, medium and large businesses.
In accordance with paragraph 2 of the Rules for the Use of Highways, roads of defense significance, approved by the Order of the Minister of Investment and Development of the Republic of Kazakhstan dated December 29, 2015 No. 1267, the concept of the subject of an offense is given. Highway users are individuals and legal entities who are road users or carry out other activities within the right-of-way and roadside lanes.
The subjective side of the commented article can be expressed both in the form of direct intent and carelessness.
The heads of the authorized body in the field of transport and communications, its territorial divisions and their deputies have the right to consider cases of administrative offenses provided for in Article 633 of the Administrative Code and impose administrative penalties.
