Article 51. Powers of the Public Monitoring Commission of the Law on the Procedure and Conditions of Detention of Persons in Special Institutions, Special Premises providing Temporary Isolation from Society

Article 51. Powers of the Public Monitoring Commission of the Law on the Procedure and Conditions of Detention of Persons in Special Institutions, Special Premises providing Temporary Isolation from Society

   1. The Public Supervisory Commission, as well as members of the public supervisory Commission, may:

     1) consisting of at least two members of the public monitoring commission, freely visit special institutions in accordance with the procedure determined by the central executive bodies;

     2) to talk with persons held in special institutions, with the consent of these persons, as well as to accept appeals regarding violations of their rights, freedoms and legitimate interests.;

     3) apply to the administration of a special institution and (or) to the prosecutor's office on issues related to ensuring the rights and legitimate interests of persons held in special institutions.

     2. For the period of the introduction of special conditions in special institutions, the powers of the public monitoring commission to visit these institutions are suspended.

     3. In exercising their powers, members of the public monitoring commission are required to comply with the provisions of regulatory legal acts that ensure the activities of special institutions, as well as to comply with the legal requirements of the administration of these institutions. The conduct of public control measures should not create obstacles to the implementation of procedural actions.

 

The Law of the Republic of Kazakhstan dated March 30, 1999 No. 353-I.

     This Law defines the legal basis for the activities of special institutions and special premises that legally provide temporary isolation from society, as well as establishes the rights and obligations of the persons contained therein.
