Commentary to article 702. Structural divisions of the internal affairs bodies, the National Security Committee of the Republic of Kazakhstan and the Ministry of Defense of the Republic of Kazakhstan that carry out state sanitary and epidemiological control and supervision  The Code of the Republic of Kazakhstan on Administrative Offences  

     1. Structural divisions of the internal affairs bodies, the National Security Committee of the Republic of Kazakhstan and the Ministry of Defense of the Republic of Kazakhstan, carrying out state sanitary and epidemiological control and supervision, consider cases of administrative offenses provided for in Article 425 (part one) of this Code on violations of sanitary rules and hygienic standards at facilities, respectively: subordinate to the internal affairs bodies and the National Security Committee security of the Republic of Kazakhstan; located on the territory of military camps and training centers of the Ministry of Defense of the Republic of Kazakhstan.

     2. The heads and their deputies or authorized officials of the structural divisions of the internal affairs bodies, the National Security Committee of the Republic of Kazakhstan, and the Ministry of Defense of the Republic of Kazakhstan who carry out state sanitary and epidemiological control and supervision have the right to consider cases of administrative offenses and impose administrative penalties.

     Part 1. State sanitary and epidemiological control and supervision is aimed at preventing, detecting, and suppressing violations of the legislation of the Republic of Kazakhstan in the field of sanitary and epidemiological welfare of the population, as well as monitoring compliance with regulatory legal acts in the field of sanitary and epidemiological welfare of the population, hygienic standards and technical regulations in order to protect public health and habitat and safety products, processes, services (Part 1 of Article 21 of the Code of the Republic of Kazakhstan "On the Health of the people and the healthcare system").

     The objects of state sanitary and epidemiological control and supervision are individuals and legal entities, buildings, structures, products, equipment, vehicles, soil, water, air, food and other objects whose activities, use, use, application and operation may harm human health and the environment.

     The officials of the sanitary and epidemiological service, authorized in accordance with the Code on the Health of the People and the Healthcare System to carry out state sanitary and epidemiological control and supervision, are:

     1) The Chief State sanitary doctor of the Republic of Kazakhstan and his deputies, the chief state sanitary doctors in the relevant territories and transport, their deputies, determined by the head of the state body in the field of sanitary and epidemiological welfare of the population;

     2) heads, their deputies and specialists of the state body in the field of sanitary and epidemiological welfare of the population;

     3) heads, their deputies and specialists of territorial divisions of the state body in the field of sanitary and epidemiological welfare of the population in the relevant territories and transport;

     4) heads and specialists of structural divisions of the Ministry of Defense of the Republic of Kazakhstan, national security and internal affairs agencies, departments of the Office of the President of the Republic of Kazakhstan, engaged in activities in the field of sanitary and epidemiological welfare of the population.

     When carrying out state sanitary and epidemiological control and supervision, authorized structural divisions of the Ministry of Defense of the Republic of Kazakhstan, national security and internal affairs bodies have the right to consider cases of administrative offenses in accordance with the conditions provided for in Part 1 of Article 702 of the Administrative Code.

     A structural subdivision of a government agency is an officially designated part of a government agency that is assigned some of the tasks, functions and responsibilities of a government agency in order to implement a specific area of its activities.

     The Ministry of Defense of the Republic of Kazakhstan is the central executive body implementing state policy in the field of defense, military-political and military-economic management of the Armed Forces of the Republic of Kazakhstan, as well as the authorized body in the field of state aviation.

     The internal affairs bodies of the Republic of Kazakhstan are a law enforcement agency designed to protect the life, health, rights and freedoms of man and citizen, the interests of society and the state from unlawful encroachments, protect public order and ensure public safety.

     The national security bodies of the Republic of Kazakhstan are special state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, which are an integral part of the security system of the Republic of Kazakhstan and are intended, within the limits of their powers, to ensure the security of individuals and society, the protection of the constitutional order, state sovereignty, territorial integrity, economic, scientific, technical and defense potential of the country.

     Part 2. The heads and their deputies or authorized officials of the divisions of the specified state bodies carrying out state sanitary and epidemiological control and supervision, consider cases of administrative offenses provided for in Part 1 of Article 425 "Violation of the requirements of legislation in the field of sanitary and epidemiological welfare of the population, as well as hygienic standards" of the Administrative Code and impose administrative penalties for committing them.

     At the same time, it is imperative that this case be about violations of sanitary rules and hygiene standards at facilities, respectively.:  

     - subordinate bodies of internal affairs and the National Security Committee of the Republic of Kazakhstan;

     - located on the territory of military camps and training centers of the Ministry of Defense of the Republic of Kazakhstan.
