Article 1. The basic concepts used in this Law Chapter 1. General provisions The Law on Defense and the Armed Forces of the Republic of Kazakhstan
The following basic concepts are used in this Law:
1) civilian personnel – citizens of the Republic of Kazakhstan who are in public service or are in an employment relationship in the Armed Forces of the Republic of Kazakhstan;
2) special forces – military units and units of engineering and chemical support, intelligence, communications, electronic warfare, information security, designed to perform special tasks to ensure the combat activities of the Armed Forces of the Republic of Kazakhstan, other troops and military formations;
3) special formations – formations created by state bodies and organizations, regardless of the form of ownership in the defense system, when mobilization is announced for the protection and restoration of industrial, agricultural, transport, transport infrastructure and communications facilities, the provision of medical services (assistance), as well as the localization and elimination of emergency situations.;
3-1) Special operations Forces – a part of the Armed Forces of the Republic of Kazakhstan intended for conducting special operations of the Armed Forces of the Republic of Kazakhstan, as well as performing tasks in accordance with the legislation of the Republic of Kazakhstan;
4) operational equipment of the territory – a set of measures aimed at preparing and maintaining in constant readiness transport facilities, road networks, warehousing, communications, water, heat and energy supply for operation for the operational solution of tasks for defense purposes;
5) territorial troops – military units and subunits (formations) of territorial defense, which are an integral part of the Armed Forces of the Republic of Kazakhstan, designed to perform appropriate tasks within the borders of the administrative-territorial unit of the Republic of Kazakhstan; - Excluded by the Law of the Republic of Kazakhstan dated June 30, 2025 No. 202-VIII SAM
6) special deployment of territorial troops – the recruitment of military units and subunits (formations) of territorial defense by conscripting those liable for military service to special military training camps to carry out measures to introduce and ensure a state of emergency, eliminate natural and man-made emergencies and their consequences, and in other cases determined by the President of the Republic of Kazakhstan; - Excluded by the Law of the Republic of Kazakhstan dated June 30, 2025 No. 202-VIII SAM
6-1) territorial bodies of territorial troops – tactical military management bodies of territorial defense of regions, cities of republican significance, the capital, functioning on the rights of military units and subdivisions of the Armed Forces of the Republic of Kazakhstan; - Excluded by the Law of the Republic of Kazakhstan dated June 30, 2025 No. 202-VIII SAM
7) territorial defense – a set of measures implemented by the Government of the Republic of Kazakhstan in order to protect the population, facilities and communications of the Republic of Kazakhstan from enemy actions, acts of sabotage or terrorism, as well as the introduction and enforcement of a state of emergency or martial law; - Excluded by the Law of the Republic of Kazakhstan dated June 30, 2025 No. 202-VIII SAM
8) the office of the military attache – the defense attache (military attache), his deputies and assistants, who are military personnel representing the interests of the Armed Forces of the Republic of Kazakhstan in a foreign country;
9) military management bodies – strategic, operational-strategic, operational-territorial, operational-tactical, tactical and local military management bodies;
10) a military unit is a republican state institution that is an organizationally independent unit of the Armed Forces of the Republic of Kazakhstan, other troops and military formations, to which conditional and (or) valid names are assigned.;
10-1) military communications bodies – military units that are part of the Armed Forces of the Republic of Kazakhstan that plan and organize military transportation, control the preparation of railway, sea, inland waterway and air transport for military transportation, as well as perform tasks in accordance with the laws of the Republic of Kazakhstan;
11) automated military management system – a system designed to collect, process, store, search, distribute, transmit and provide information using a hardware and software package for decision-making, planning, setting and communicating tasks to troops (forces), monitoring their execution in order to control troops (forces) in peacetime And wartime;
11-1) military information and communication infrastructure - a set of information and communication infrastructure facilities that ensure the functioning of the military organization of the state;
11-2) unified operator of military information and communication infrastructure – a legal entity with the full participation of the state, which is entrusted with the functions of project management for the creation of military information and communication infrastructure facilities, as well as the functions of their implementation, maintenance, development, integration and system maintenance, providing consulting assistance to subjects of military information and communication infrastructure of government agencies and ensuring compliance with information security information and communication technologies.military communications infrastructure;
12) military property – defense facilities, all types of weapons, military equipment, special equipment and other property under the right of operational management of state institutions of the Armed Forces of the Republic of Kazakhstan, other troops and military formations;
13) military equipment – combat vehicles, warships (boats and other vessels), military aircraft and other aircraft equipped with the Armed Forces of the Republic of Kazakhstan, other troops and military formations;
14) a branch of the armed forces is an independent or integral part of the Armed Forces of the Republic of Kazakhstan, which has its own main weapons and military equipment, as well as methods of their combat use.;
15) other troops and military formations – The Border Guard Service, the Aviation Service, the Border Academy, military counterintelligence and military police bodies of the National Security Committee of the Republic of Kazakhstan and other units of the national security bodies of the Republic of Kazakhstan, determined in accordance with the procedure established by the legislation of the Republic of Kazakhstan, Special forces of the State Security Service of the Republic of Kazakhstan, the National Guard of the Republic of Kazakhstan, military investigative bodies of the Ministry of Internal Affairs of the Republic of Kazakhstan, administrative bodies and military units of the civil defense of the authorized body in the field of civil protection, bodies of the military prosecutor's office;
15-1) unified military-technical policy is a system of conceptual views and practical actions implemented by government agencies in the interests of ensuring high technical equipment of the Armed Forces of the Republic of Kazakhstan, other troops and military formations, taking into account the practical tasks assigned to them, the economic capabilities of the state and the state of the military–political situation;
16) supply standards (in–kind standards) - the amount of material assets prescribed for issue in peacetime or wartime to military personnel, units, military units (ships) and formations;
17) combat readiness is a condition that determines the degree of readiness of the Armed Forces of the Republic of Kazakhstan, other troops and military formations to perform their assigned tasks within the established time frame.;
18) combat capability – the state of the troops (forces) The Armed Forces of the Republic of Kazakhstan, other troops and military formations, allowing them to conduct combat (military, special) operations in accordance with their purpose and to realize their combat capabilities;
19) combat mission – a task assigned by a superior commander (chief) to achieve a specific goal in combat (operation) by a set deadline;
20) high command (supreme command staff) – the Minister of Defense of the Republic of Kazakhstan, his deputies, the commanders-in-Chief of the Armed Forces of the Republic of Kazakhstan and other officials appointed by the President of the Republic of Kazakhstan;
20-1) special deployment of the territorial troops of the Armed Forces of the Republic of Kazakhstan – recruitment of military units and subunits of the territorial troops of the Armed Forces of the Republic of Kazakhstan by conscription for special military training to carry out measures to introduce and ensure a state of emergency, eliminate natural and man-made emergencies and their consequences and in other cases determined by the President of the Republic of Kazakhstan;";
21) military intelligence agencies of the Ministry of Defense of the Republic of Kazakhstan – units of the Armed Forces of the Republic of Kazakhstan engaged in intelligence and operational search activities in accordance with the laws of the Republic of Kazakhstan;
22) The Armed Forces of the Republic of Kazakhstan (hereinafter referred to as the Armed Forces) are the basis of the military organization of the state, created and maintained by the Republic of Kazakhstan to ensure defense, repel aggression or prevent an immediate external threat, as well as to perform tasks arising from the international obligations of the Republic of Kazakhstan.;
22-1) the defense plan of the Republic of Kazakhstan – a set of interrelated documents on ensuring the defense of the state;
23) armament – various types of weapons, complexes and systems designed to destroy manpower, equipment and infrastructure, destroy buildings (fortifications), means imitating these components, ammunition, as well as systems, devices, carriers and devices that ensure their use in the Armed Forces, other troops and military formations;
24) components for armament and military equipment – components that together form the structural integrity of armament and military equipment, and spare parts and accessories for armament and military equipment;
25) special operations of the Armed Forces – a special form of use of the Armed Forces in peacetime and wartime;
26) restricted area at the arsenals, bases and depots of the Armed Forces, other troops and military formations (hereinafter referred to as the restricted area) is the territory directly adjacent to the arsenals, bases and depots of the Armed Forces, other troops and military formations and is part of the restricted area at the arsenals, bases and depots of the Armed Forces, other troops and military formations. military formations;
27) forbidden area at the arsenals, bases and depots of the Armed Forces, other troops and military formations (hereinafter referred to as the forbidden area) – the territory adjacent to the arsenals, bases and depots of the Armed Forces, other troops and military formations, within which prohibitions and restrictions are established;
28) inventory of armaments and military equipment of the Armed Forces, other troops and military formations – a systematic set of information compiled periodically on the basis of data on armaments and military equipment, consisting of equipment, their qualitative characteristics, purpose, manufacturer, date of manufacture, acceptance and decommissioning;
29) type of Armed Forces – a part of the Armed Forces of a State intended for conducting military operations in a certain area (on land, at sea, in the airspace);
30) defense is a system of state measures of a political, military, economic, informational, environmental, socio-legal and other nature to ensure military security, armed protection of sovereignty, territorial integrity and inviolability of the State border of the Republic of Kazakhstan.;
31) defense facilities – immovable property assigned by the right of operational management to state institutions of the Armed Forces, other troops and military formations;
32) defense research – research in the field of defense and military security, including strategic, applied, analytical and sociological research aimed at solving issues of the development of the military organization of the state, the art of war, the development, creation of new types of weapons, military equipment, technical and special means, their implementation, modernization of existing weapons, equipment, supply and operation of samples of weapons and military equipment, construction and support of the Armed Forces, territorial defense of the Republic of Kazakhstan;

35) logistical support – a set of measures carried out to provide the Armed Forces, other troops and military formations with weapons, military equipment and other property, their repair and restoration, to meet the material, medical, transport, household and other needs of the Armed Forces, other troops and military formations to maintain their combat readiness and Combat use;
36) the military organization of the state is the totality of the Armed Forces, other troops and military formations, government agencies, organizations and the military–industrial complex, whose joint activities are aimed at solving the tasks of ensuring military security and defense of the Republic of Kazakhstan.;

41) unused military property – property that has been decommissioned, is not suitable for its intended use, has been decommissioned, has served its warranty period of storage in reserves, and is not used excessively in the Armed Forces, other troops and military formations.;
42) state of war – the relations of states from the moment of the declaration of war between them (the actual beginning of hostilities) to its end (the actual cessation);
43) a military threat is a real intention to resolve existing contradictions by military force, to unleash a military conflict (war) against the Republic of Kazakhstan;
44) military danger is a factor of instability, suggesting the possibility of using military violence against the Republic of Kazakhstan to achieve political and other goals;
45) military operations – a set of actions on a strategic scale (including combat operations) using all types of Armed Forces to carry out assigned combat tasks while repelling aggression;
46) wartime – the period from the moment of the declaration of a state of war or the actual outbreak of hostilities until the moment of the announcement of the cessation of hostilities, but not before their actual cessation;

48) combat operations – organized actions of military units, formations and subunits in the performance of combat missions under the control of the relevant military authorities.

This Law regulates public relations in the field of organization of defense and the Armed Forces of the Republic of Kazakhstan, the functions and powers of state bodies in ensuring the country's defense capability, the rights and obligations of citizens and organizations in the field of defense.
