Article 54. Requirements for a candidate for President of the Republic of the Constitutional Law on Elections in the Republic of Kazakhstan

     1. To be elected President, a citizen must meet the requirements set out in paragraph 2 of Article 41 of the Constitution, have at least 5 years of experience in public service or in elected government positions, and have the right to vote in accordance with paragraphs 2 and 3 of Article 33 of the Constitution and this Constitutional Law.

     2. The compliance of a presidential candidate with the requirements imposed on him by the Constitution and this Constitutional Law shall be established by the Central Election Commission within five days from the date of submission of an extract from the minutes of the meeting of the supreme body of the Republican public association on the nomination of a candidate, together with the candidate's statement of consent to run and a document certifying that the candidate has made an election contribution.

     A presidential candidate pays an election contribution to the account of the Central Election Commission in the amount of fifty times the minimum wage established by law. The contribution paid is refunded to the candidate in cases where, following the results of the election, the candidate was elected President of the Republic or, following the results of the vote, the candidate won at least five percent of the votes of the voters who took part in the voting, as well as in the event of the candidate's death. In all other cases, the contribution is non-refundable and is transferred to the revenue of the republican budget.

     At the same time, the fact of residence of a presidential candidate in the Republic of Kazakhstan for the last fifteen years is established by the Central Election Commission, and the procedure for establishing the candidate's fluency in the state language is determined by a resolution of the Central Election Commission in accordance with the decision of the Constitutional Council of the Republic on the official interpretation of paragraph 2 of Article 41 of the Constitution.

     The procedure for establishing a candidate's fluency in the State language does not apply to the current President of the Republic, whose candidacy has been re-nominated for the next term of office.
