Driving a driver who does not have the right to drive vehicles, which has caused the death of a person by negligence
By the verdict of the Tekeli City Court of the Almaty region dated May 20, 2020, K. was found guilty of allowing the owner of the vehicle to drive a driver who did not have the right to drive the vehicle, which negligently caused the death of a person. According to part 3 of Article 349 of the Criminal Code, he was sentenced to imprisonment for a period of 1 year with deprivation of the right to drive a vehicle for a period of 1 year and 6 months, while serving his sentence in a minimum security penal institution. On October 27, 2019, K., driving a Volkswagen Passat car, allowed his wife Z., who was intoxicated and did not have the right to drive vehicles, to drive the car. On the way, Z., having lost control of the steering, allowed the car to roll over.
As a result of the accident, she herself died at the scene, and the minor passenger in the car, V. D., born in 2013, received serious bodily injuries. By the decision of the Judicial Board for Criminal Cases of the Almaty Regional Court dated July 1, 2020, the sentence against K. was changed. The term of the additional punishment imposed by the court on K. in the form of deprivation of the right to drive a vehicle was increased to 3 years. The rest of the verdict was left unchanged.
