Article 1. The basic concepts used in this Law Chapter 1. General provisions of the Law on State Secrets

     The following basic concepts are used in this Law:

     state secrets are information protected by the state, constituting state and official secrets, the dissemination of which is limited by the state in order to carry out effective military, economic, scientific, technical, foreign economic, foreign policy, intelligence, counterintelligence, operational search and other activities that do not conflict with generally accepted norms of international law.;

     A protected information system classified as state secrets is a restricted access information system designed to create, search, collect, process, accumulate, store, distribute, display, use and consume information containing state secrets.;

     An electronic information resource containing information constituting state secrets is information provided in electronic and digital form and contained on electronic media in a secure information system classified as state secrets.;

     state secret - information of a military, economic, political and other nature, the disclosure or loss of which causes or may cause damage to the national security of the Republic of Kazakhstan;

     official secret - information having the character of separate data that may be part of a state secret, the disclosure or loss of which may harm the national interests of the state, the interests of state bodies and organizations of the Republic of Kazakhstan;

     security stamp - details indicating the degree of secrecy of the information contained in their medium, affixed to the medium itself and (or) in the accompanying documentation for it.;

     access to information constituting state secrets is the familiarization of a specific person with information constituting state secrets authorized by an authorized official.;

     access to state secrets is a procedure for registering the right of citizens to access information constituting state secrets, and organizations to carry out work using such information.;  

     The classification of information and its media is a set of measures to restrict, in the interests of ensuring the national security of the state, the dissemination of information constituting state secrets and access to their media.;

     carriers of information constituting state secrets are material objects, including physical fields, in which information constituting state secrets is reflected in the form of symbols, images, signals, technical solutions and processes.;

     declassification of information is a set of measures to remove restrictions in compliance with the interests of national security of the state, established for the dissemination of information constituting state secrets and access to their media;

     The system for the protection of state secrets is a set of bodies for the protection of state secrets, the means and methods they use to protect information constituting state secrets and their carriers, as well as activities carried out for these purposes.;

     means of protecting information constituting state secrets are technical, cryptographic, software and other means designed to protect information constituting state secrets, the means in which they are implemented, as well as means of monitoring the effectiveness of protecting state secrets.;

     disclosure of state secrets is the communication, transmission, provision, forwarding, publication or communication of state secrets by any other means to legal entities and individuals who are not granted the right to familiarize themselves with them.;

     loss of state secrets is the withdrawal, including temporary, of information constituting state secrets from lawful possession or use as a result of loss or theft.

 

 

The Law of the Republic of Kazakhstan dated March 15, 1999 N 349-1.

     This Law defines the legal framework and a unified system for the protection of state secrets in the interests of ensuring the national security of the Republic of Kazakhstan, regulates public relations arising in connection with the classification of information as state secrets, their classification, disposal, protection and declassification.
